2000024 70 <br />Island, Hall County, Nebraska; the centerline of the Twenty (20.0) foot wide easement and right -of- <br />way being more particularly described as follows: <br />Beginning at the southwest corner of said Northwest Quarter of the Southwest <br />Quarter (NW' /4 SW' /4); thence running easterly along the south line of the Northwest <br />Quarter of said Northwest Quarter of the Southwest Quarter (NW' /4 SW' /4), to a point <br />Eight Hundred Sixty Nine and Five Tenths (869.5) feet east of the west line of said <br />Northwest Quarter of the Southwest Quarter (NW' /4 SW' /4); thence running northerly <br />parallel with and Eight Hundred Sixty Nine and Five Tenths (869.5) feet east of the <br />west line of said Northwest Quarter of the Southwest Quarter (NW' /4 SW' /4), a <br />distance of approximately Nine Hundred Sixty and Forty Five Hundredths (960.45) <br />feet, to the ACTUAL point of beginning; thence continuing northerly parallel with <br />and Eight Hundred Sixty Nine and Five Tenths (869.50) feet east of the west line of <br />said Northwest Quarter of the Southwest Quarter (NW' /4 SW' /4), a distance of <br />approximately Three Hundred Fifty Seven and Sixteen Hundredths (357.16) feet, to <br />a point on the north line of said Northwest Quarter of the Southwest Quarter (NW' /4 <br />SW' /4), and to the point of termination, said tract containing 0.164 acres more or less, <br />as shown on the plat dated September 13, 1999 attached hereto and incorporated <br />herein by this reference; <br />together with the following rights, namely, unrestricted ingress and egress under, over, and across <br />such land for the purpose of exercising the rights herein granted, to excavate and refill ditches and <br />trenches, and the right to clear and keep clear of trees, roots, brush, hedges, undergrowth, and other <br />obstructions from the surface of such tracts interfering with the location, construction, inspection, <br />repair, replacement, removal, and maintenance of such utilities. Any such utilities and <br />appurtenances placed upon, over, and under such tracts of land shall remain the property of the <br />Grantee and may be removed or replaced at any time. <br />The Grantors, for themselves, their heirs, executors, administrators, successors, and assigns, <br />hereby covenant that no buildings, fences, or structures shall be erected or permitted on said tract and <br />that the easement herein granted shall run with the title to such tract of land and be binding upon the <br />Grantors, their successors and assigns. <br />-2- <br />
