IT IS THEREFORE AGREED: 1. The Lease Agreement attached hereto as Exhibit "A" and made a part hereof by this reference affects the following de- scribed real property: Plat of a tract of land comprising a part of the South- east Quarter (SE1 /) of Section Twenty -Two (22), Township Eleven (11) North, Range Nine (9) West of the 6th P.M., in Hall County, Nebraska, more particularly described as follows: Beginning at the northeast corner of said South- east Quarter (SE1 /); thence southerly along the east line of said Section Twenty -Two (22), a dis- tance of One Thousand Nine Hundred Sixty -Five (1,965.0) feet; thence deflecting right 89 054' and running westerly a distance of Two Hundred Fifty - Three and Eighty -Eight Hundredths (253.88) feet, to the ACTUAL place of beginning; thence continu- ing westerly along the last described course, a distance of One Hundred Two (102.0) feet; thence deflecting right 90 000' and running northerly, a distance of Ninety -Six (96.0) feet; thence de- flecting right 90 000' and running easterly a dis- tance of One Hundred Two (102.0) feet; thence de- flecting right 90 000' and running southerly, a distance of Ninety -Six (96.0) feet to the ACTUAL place of beginning and containing 0.225 acres more or less. 2. The Lease Agreement attached hereto as Exhibit "A" and made a part hereof by this reference is terminated. Said Lease Agreement was recorded January 29, 1973 in Miscellaneous Book 24, Page 162 of the records of the Register of Deeds of Hall County, Nebraska. SHELTON and LYNN BLAND SHELTON, husband and wife, here- inafter referred to as "Sheltons" and HALL COUNTY LIVESTOCK IMPROVEMENT ASSOCIATION, a Nebraska non - profit corporation, here- inafter referred to as " Fonner Park" on this Q_& day of February, 2001. WHEREAS, Sheltons entered into a Lease Agreement with Fonner Park, a copy of which is attached hereto as Exhibit "A" and made a part hereof by reference; and WHEREAS, Sheltons have entered into an Agreement for Sale and Purchase of Leasehold Improvements for the sale of leasehold improvements described in such Lease Agreement from the Sheltons to Fonner Park; and WHEREAS, Sheltons and Fonner Park desire to terminate the Lease Agreement attached hereto as Exhibit "A" and made a part hereof by reference.
