<br /> PAYMENT AND PERFDRMANGE. Except as otherwise pro��d�d in this ❑eed of Trust, Trustor shall pay �a Lender a��
<br /> amounts secur�d by th�s Deed of Trust as they became due, and shail s�ri��ly and in a timely manner p��f�rm a�l qf
<br /> Trustor's obligatians under the Credit Agreement, this Deed�f T�-ust,and�he Related Docum�nts.
<br /> P�SSESS��N AND MAINTENANCE QF THE PROPERTY. Trustor agrees #hat Trustor`s possessian and u�e of the
<br /> Property sha�l be ga���ned by the faliowing p�o�isions:
<br /> Pvssession and-Use. Unti� the occurrence a� an E�ent of Defaul�, Trustor may ��l} remain �n possess�on and
<br /> control�f the Proper�y; �2} use,operate ar manage the Propet�y; and �3} collect the Rents from�he Proper�y.
<br /> Duty to M�intain. Trustor shall mainta�n the Property in gaod condition and prampt�y pe�form all repa�rs,
<br /> replacements,and ma�ntenan��necessary to pre�erve i�s�a�u�.
<br /> Cvmpliance W�th En�ironmental Laws. Trustor rep�esen�s and warrants#o Lender that: (1} During the period of
<br /> Trus�or's ownership of�he Property, fhere has been no use,generation, manufactur�,storage, treatment, disposal,
<br /> r�lease ❑r thr�a��ned relea�e ❑f any Hazardous Su�stance by any pers�n on, under, about or from the Property;
<br /> �2} Trustor has na knawledge af, or reason ta belie�e that#here has been, excep�as p�e��ously disclosed �o and
<br /> acknawledged hy Lender in writing, �a} any breach or �iaia�ion af any Envir�nmental Laws, (b} any use,
<br /> generation, manu�acture, storage, trea�ment, disposal, re�ease or�hreatened release ❑f any Ha�ardous Substance
<br /> an, under, about or from the Property by any prior owners or occupan�s af�he Property, or �c} any actual ar
<br /> threatened IEtigation or claims a�any kind by any person relating to �uch ma�fiers; and �3} Except as pr��ioWsiy
<br /> disclosed to and acknawledged by Lender in writing, {a} ne��her Trust�r nor any tenant, contractor, a�ent or other
<br /> autho�ized user o�the P�-operty shall use, generate, manufacture, stvre, treat, dispose a�or release any Hazardous
<br /> Substance on, under, about or�r�m�he Proper�y;and �b} any such acti�ity shall be candu�ted�n comp�ian�e with
<br /> all applicable federa�r Std�E, and �ocaf laws, regu�ations and ordinances, including wi�h�ut �imitation all
<br /> Enviranmental Laws. Trustor au�hori�es Lender and its agents to en#er upan �h� Prope�ty to make such
<br /> insp�ct�ons and tests, �t Trus�or's expens�:, as�Lender may d�em appropriate to determ�ne �ompliance of the
<br /> Property with �his sec#ion of the ❑eed of Trust. Any inspections �r tes�s made by L�nder shall be f�r Lende�`s
<br /> pur�oses an�y and shall not be const�ued �o create any respansibility or liability on the part o�Lender�a Trustor ar
<br /> t� any other person. The represen�a#ions and warranties contained herein are based on Trusto�-'s du�di�igence in
<br /> in�estigating the Property f�r Hazardous Substances. Trustor hereby �1} reieases and wa��es any fu#ure claims
<br /> against Lende��ar indsmni�y ar contribution in the e�ent Trusto�becomes �iable �or cleanup ar othe�-costs under
<br /> any such �aws; and ��} agrees to indemnify, defend, and hold harmless Lender against any and all claims, losses,
<br /> liab�lities, damages, pen�lties, and expenses which Lender may directly or�ndirectly sus#ain or suffer result�ng from
<br /> a breaeh of this section of the Deed of Trust or as a c�nsequence v�any use, g�neration, manufa�ture, s�orage,
<br /> disposal, ��I�ase or�hreatened releas�accurring prior to Trustar's ownershEp ar interest in th�Property,whe�her ar
<br /> nat the same was o�- should have b�en knowt� to T�ustor. �h� �lt"�V154�C�S o�tk�is section of the ❑e�d of Trust,
<br /> including the ob�igat�on to indemnify and defend, sha�l su�-v��e the payment of the �ndebtedness and the satis�ac�ian
<br /> and recon�eyance of the �ien of this Deed of Trust and shal� not be affected by Lender`s acquisition ❑�any in#e�est
<br /> in the Property,whe�her by foreclosu�-e or�therwise.
<br /> Nuisance, 1Nas#e. Tru��or shal� not cause, conduct or perm�# any nuEsance nor commi�, pe�mit, c�r suffer any
<br /> strippin� af or was�e an ❑r to the Property�r any portion of the Praper�y. Without iimiting the g�nerali�y of th�
<br /> fore�oing, Trust�r will nat remo�e, o�gran't�o �ny other party the right�a r�mo�e, any timber, mine�a�s �including
<br /> ❑il and gas}, coai, c�ay, scoria, sa�i, gra�el or�ock produc#s without Lender's priar vu�-i��en cnnsen�.
<br /> Remo�a�of lmprn�ements. Trustar shall not demolish ar�emv�e any[mpro�ements�rom the Real Property without
<br /> L�nder's prior written cansen�. As a cflndition to�he�-em��al o�any�mp�o�ements, Lender may require Trustor ta
<br /> mak� arrangements satisfac�ary to Lender to repla�e such �mpro�ements with Impro�emen�s o� at least equal
<br /> �aEue.
<br /> Lender's Righ#to En�er. Lender and L�nder's agents and representati�es may�nter upon th� Real Praper�y a#a!1
<br /> reasvnable times ta attend to Lender's inter�sts and to inspeGt the Rea� Prop�rty for purposes af Trus�or's
<br /> compliance wi�h�he terms and conditions of this ❑eed of Trust.
<br /> Compliance with Ga�ernmental Requirements. Trustor shall promptly comp�y wi�h a�� laws, ardinanc�s, and
<br /> regu�at�ons, novu or h�rea�ter in effec#, o�all go�e�nmental autharities applicable to #h� us� or occupancy o�the
<br /> Property. Trustor may contest in good faith any such law, ordinance,or regulation and withhold campliance durin�
<br /> any proeeeding, ineluding approp�-ia�e appeals, so ivng as T�us�ar has natified L�nde� in wri�ing priar t❑ doing so
<br /> and sa [ong as, in Lender's sole apinion, Ler�der's in'�eres�s in�he Proper�y are nnt jeopa�-diz�d. Lender may require
<br /> T�ustar to post adequate security or a surety band, reasonabiy satis�a�tory to Lender,to protecfi Lender's interes#.
<br /> Duty #o Protec�. Trustar agrees nei�her to abandon or lea�e una�tended the Prape�ty. Trustor shall do a�1 o#her
<br /> acts, in addition to those acts set fiorth abo�e in this section,which from the character and use��the Property ar�
<br /> reasonably necessary ta protect and prese�-ve the Prop�rty.
