Box 1600, Kearney, NE 68848 -1600 <br />AFFIDAVIT OF SURVIVING SPOUSE <br />Affiant, Judith J. Resh, after being duly swdrn upon oath, does depose and state as <br />1. That affiant is the surviving spouse of Rodney L. Resh, also known as Rodney <br />LeRay Resh (hereinafter referred to as the "decedent "), who departed this life on January 24, <br />2011, as shown by the certified copy of the death certificate attached hereto as Exhibit "A" <br />and by this reference incorporated herein. <br />2. That on the date of death, the affiant and the decedent were the sole owners as <br />joint tenants with rights of survivorship of that real property described as follows: <br />The West Half of the Southwest Quarter (WVViSW /a) of Section 5, Township 9 <br />North, Range 12 West of the 6 P.M., Hall County, Nebraska; and <br />The East Half of the Southeast Quarter (EV2SE1/4) of Section 6, Township 9 <br />North, Range 12 West of the 6 P.M., Hall County, Nebraska, EXCEPT a tract <br />of land comprising a part of said East Half of the Southeast Quarter (E %ZSE' /a) <br />of said Section 6, more particularly described as follows: Beginning at a point <br />on the east line of said East Half of the Southeast Quarter (E %2SE' ), said point <br />being 370 feet south of the Northeast corner of said East Half of the Southeast <br />Quarter (E%SE' /a); thence deflecting right 89 °07' and running Westerly a <br />distance of 302.12 feet; thence deflecting left 79°51' and running Southwesterly <br />a distance of 298.73 feet; thence deflecting left 32 °21' and running southeasterly <br />a distance of 124.04 feet; thence deflecting left 65 °36' and running easterly a <br />distance of 301.34 feet to a point on the east line of the East Half of the <br />Southeast Quarter (E'/2SEI /a); thence running north along the east line of said <br />East Half of the Southeast Quarter (E' /2SE') a distance of 420.45 feet to the <br />point of beginning (said exception containing 3.1 acres, more or less). <br />3. That by virtue of the survivorship of affiant, affiant became the sole owner of the <br />above - described property. <br />4. That this affidavit is given as evidence that pursuant to Neb. Rev. Stat. §77 -2003 <br />(Reissue 2009) no inheritance tax lien arising due to the death of the decedent can attach to <br />the above - described real estate. <br />5. That no federal estate tax return has or will be filed as the gross estate of the <br />decedent was less than that amount necessary to require the filing of such a return pursuant <br />to Internal Revenue Code §6018. <br />
