Scott S ilors, President d in" ary Public 614V PLEASE RETURN TO: NEDCO, 4445 S. 86 "' Street, Suite 200, Lincoln, NE 68526 Ty TERMINATION AND RELEASE OF THIRD PARTY LENDER AGREEMENT On 09/18/2009, at the request of Nebraska Economic Development Corporation, Heritage Bank, Grand Island, as the Third Party Lender, executed a Third Party Lender Agreement whereby Heritage Bank, Grand Island, made certain representations and commitments with respect to its loan to Carpenter Real Estate Inc. and /or Grand Island Subs, Inc. (hereinafter "Borrower "). The Third Party Lender Agreement was subsequently recorded on September 23, 2009 as Document No. 200907705 in the Records of Hall County, Nebraska, relating to real estate described as: Lot Nine (9), Woodland Second Subdivision, an Addition to the City of Grand Island, Hall County, Nebraska. Since Heritage Bank, Grand Island executed the Third Party Lender Agreement, the Borrower has satisfied its obligation to the United States Small Business Administration and Nebraska Economic Development Corporation; which necessitates the termination of the Third Party Lender Agreement and Release of Heritage Bank, Grand Island from its obligations under the Third Party Lender Agreement. Premised upon the foregoing, Nebraska Economic Development Corporation, as Attorney in Fact for the United States Small Business Administration, an agency of the United States of America and assignee of the Third Party Lender Agreement, hereby terminates the Third Party Lender Agreement and releases Heritage Bank, Grand Island from its obligations under the Third Party Lender Agreement.
