This Subordination Agreement ( "Agreement ") is made this 10 day of February <br />2000 by and between Norwest Bank Nebraska, National Association, a national banking <br />association ( "Norwest ") and Bank of Wood River dba Heritage Bank a <br />State Chartered Bank (the "Creditor /Beneficiary"). <br />D & D Investments, a partnershipE�avia and Christine A. Starostka, <br />wife, and Danny R. and Janet L. Starostka, husband and wife, <br />(the `Borrower/Debtor"), gave a <br />deed of trust to the Creditor/Beneficiary, dated October 7, 1998 , and recorded <br />in the Office of the Register of Deeds for Hall County, Nebraska on <br />October 20,1998 as Document Number 98- 111114 (the "Creditor Deed <br />of Trust "), which constitutes a lien on real property located in Hall County, <br />Nebraska more particularly described herein below (the "Property"): <br />husband and <br />Subordination limited to lots 1 and 2, Colonial Apartments Subdivision, in the city <br />of Grand Island, Hall County, Nebraska <br />Norwest has now made or shall make a loan to benefit the Borrower /Debtor in the <br />amount of $ 248, 000.00 also secured by a deed of trust on the Property, dated <br />August 17, 1999 , and recorded in the Office of the Reg; firer of needs for Hall <br />County, Nebraska on August 19. 1999 , as Document Number 99- 108350 (the <br />" Norwest Deed of Trust "). <br />Creditor /Beneficiary has agreed to execute and deliver this Agreement for the <br />purpose of subordinating its interest in the Property pursuant to the Creditor Deed of <br />Trust to the interest of Norwest in the Property pursuant to the Norwest Deed of Trust. <br />AGREEMENT <br />NOW, THEREFORE, in consideration of the premises and as an inducement to <br />Norwest to accept the Norwest Deed of Trust, Norwest and Creditor /Beneficiary agree <br />as follows: <br />1. Creditor /Beneficiary agreed to subordinate, and hereby does subordinate, the lien <br />of the Creditor Deed of Trust in and against the Property to the lien of the Norwest <br />Deed of Trust in and against the Property. Creditor /Beneficiary agreed to subordinate, and hereby does subordinate, the lien <br />of the Creditor Deed of Trust in and against the Property to the lien of the Norwest <br />Deed of Trust in and against the Property. Creditor /Beneficiary agrees that the <br />Norwest Deed of Trust shall have the same validity, force and effect as if executed, <br />delivered, and recorded prior to the date of execution of the Creditor Deed of Trust. <br />
