<br />GRANT OF PERPETUAL CONSERVATION EASEMENT
<br />THIS GRANT OF EASEMENT, made this 19 day of -e ,1994, between
<br />Kenneth W. & Nancy L. Shultz, H &W, (hereinafter referred to as Grantor, whether one or more),
<br />and the City of Grand Island, Nebraska, a Nebraska Municipal Corporation, its successors and
<br />assigns, (hereinafter referred to as Holder).
<br />This easement is granted under and in accordance with the laws of the State of Nebraska,
<br />including but not limited to the Nebraska Conservation and Preservation Easements Act, NEB.
<br />REV. STAT. § 76- 2,111, et seq. (Reissue of 1990), as amended. The restrictions and covenants
<br />contained in this easement constitute a perpetual servitude upon, and run with, the land subject
<br />hereto. Grantor covenants with Holder to do, or refrain from doing, such acts as are hereinafter
<br />specified. Said easement shall be binding upon Grantor, and Grantor's heirs, personal
<br />representatives, administrators, agents, successors and assigns, forever. Holder reserves the
<br />rights enumerated in this easements for itself, its agents, representatives, successors and assigns.
<br />NOW, THEREFORE, for and in consideration of the sum of one dollar and other
<br />valuable consideration ($1.00 ), the Grantor hereby grants and conveys
<br />unto Holder, its successors and assigns, an estate, interest and perpetual conservation easement,
<br />in lands of the Grantor, together with the right of ingress and egress solely for the purpose of
<br />monitoring and enforcing the doing and refraining from doing of activities by Grantor upon such
<br />land as are hereinafter specified.
<br />I. DESCRIPTION OF LAND
<br />The land subject to this conservation easement is described as follows:
<br />Lot 4 Except that Portion Thereof Conveyed to the State of Nebraska by Deed Recorded in Book
<br />144, Page 15, and the East Half of the Southwest Quarter (E2,SW4) Except the South 442 Feet
<br />Thereof, Section 22, Township 10 North, Range 9 West of the 6' P.M., Hall County Nebraska.
