<br />PRIVATE EASEMENT
<br />KNOW ALL MEN BY THESE PRESENTS, that Robert Allan Blacketer and
<br />Melody Kay Blacketer, Husband and Wife, GRANTOR (whether one or more) in
<br />consideration of Two Hundred and no /100th Dollars ($200.00) receipt of which is hereby
<br />acknowledged, does hereby give, grant, and convey unto the MIDWEST
<br />INDEPENDENT SOIL SAMPLERS, LLC, an Iowa Limited Liability Company,
<br />GRANTEE, a perpetual easement and right -of -way over, across, under, through, and
<br />upon the following- described real estate, to wit:
<br />Commencing at the Southwest Comer of Lot Six (6) of County
<br />Subdivision of Part of the Southeast Quarter (SE %) of Section Nineteen
<br />(19), Township Ten (10) North, Range Eleven (11) West of the 6 P.M.,
<br />Hall County, Nebraska, said point being the Point of Beginning, thence
<br />N0 °0'46.10 "W along the West Line of said Lot Six (6), a distance of thirty
<br />nine and eighty two hundredths (39.82) feet to a point; thence
<br />N89 °59'13.90 "E a distance of fifteen (15.00) feet to a point; thence
<br />S0 °0'40.40 "E a distance of forty (40.00) feet to a point on the South line of
<br />said Lot Six (6); thence N89 °18'53.3 "W a distance of fifteen (15.00) feet to
<br />the Point of Beginning.
<br />Said easement includes but is not limited to the right to install, construct,
<br />maintain, replace, and operate an underground private sanitary sewer pipe by the
<br />GRANTEE within the described easement area for the benefit of Lot One (1) in Wood
<br />River Industrial Park Subdivision, in the City of Wood River, Hall County, Nebraska. It is
<br />further provided that said easement shall be deemed to provide GRANTEE with the
<br />right of unrestricted access to its private sanitary sewer line by ingress and egress over,
<br />across, through, and under the lands described herein, together with all rights of ingress
<br />and egress necessary for the full and complete use, occupation, and enjoyment of the
<br />easement hereby granted, including the right to excavate and refill ditches and
<br />trenches for the location of said sewer line and appurtenant structures related thereto,
<br />and hereby prohibiting the planting of trees, bushes, and shrubs, or placing other
<br />obstructions, in, upon, above, along, over, across, undemeath, and through the
<br />easement area.
<br />To have and to hold the same unto the said GRANTEE and its successors and
<br />assigns as appurtenant to the land and every part thereof; and GRANTOR and
<br />LENDER hereby dedicate their respective interests in said real estate to the use of the
<br />GRANTEE. This easement is perpetual and shall run with the land.
<br />The GRANTOR does hereby covenant with the GRANTEE that it is lawfully
<br />seised and possessed of the real estate described herein; that it has a good and lawful
<br />right to convey such real estate; that such real estate is free from encumbrance; and
