<br /> Nuisance, Vllaste. Trus�or shall no� Gause, cvnduct or perm€t any nuisance nor commi�, pe�rmi�, or suffer any
<br /> stripping Qf or waste on or to the Property or any portion vf the Property. Vllithout limiting the generality o� the
<br /> foregoing, Trus�or wifl no� remo�e, or grant�a any other party the right#v remo�e, any timber, min�rals {inc�uding
<br /> oil and�as}, coal, c�ay, scoria, soil, gra�el or rock producfis without Lend�r's prior written consenfi.
<br /> Remor►aN vf Impro�ements. Trus�ar shall no�demalish ar r�mo�e any Improvemen�s fram�he Real Prvperty withaut
<br /> Lender's prior written consent. As a condi�ion to the remo�a� of any Impro��men�s, Lender may requ�re Trusto�to
<br /> make arrangements satisfactory �o Lender ta replace such Impro�ements wEth Impro�em�n�s o� a� least equal
<br /> �alue.
<br /> Lender's Right to En�er. Lender and Lend�r's agents and representa�ives may en�er upon the Real Proper�y at a([
<br /> reasonable times to attend �o Lender's interests and to inspect the Rea� Property #or purposes of Trustvr's
<br /> �ompliance with�he terms and conditions af�his Deed af Trust.
<br /> Compliance with Gca�ernmental Requireme�fis. Trustor sha�� pr�mptly comp[y with al� laws, ordinances, and
<br /> regufations, now ar hereaft�r in e�#fect. ofi all ga�ernmen�al authorities applicahle fio the use or occupancy of the
<br /> Property, in�luding wi�hout limitation, the Ar�ericans Vtilith Disabifities Ac�. Trustor may contest in good �fai�h any
<br /> such law, ordinance, ar regulativn and withhold comp�iance durin� any proceeding, including apprapriate appeals,
<br /> sv long as Trustor has noti�ied Lender in writing prior tv doing so and so long as, in Lender's sole opin�vn, L�nder's
<br /> in�terests in the Property are not �eopard�zed. Lender may requi�e Trustor to post �dequate security ar a surety
<br /> bond, reasvnabfy satisfactory to Lender, to pr�tec�Lender's int�resfi.
<br /> Duty to Prntect. Trustar a�r�es neither ta abandvn or lea�e unattend�d �he Praperty. Trustvr shall do a�� other
<br /> aG�s, in addition ta those acts set forth ai�ove in this se��tivn, which from the character and use of�he Praperty are
<br /> reasvnably necessary to pro�ec�and preser�e th� Property.
<br /> DUE DN SALE- C�NSENT �Y LENDER. Lender may, at Lend�r's op�ian, d�cfare immediately due and payable a�� sums
<br /> secured by this Deed ofi Trust upon the sale or t�ansfer, without Lender`s prior writ�en consen�, �f al� or any pa�fi of the
<br /> l�eal Property, vr any interes�in the Real Proper�y. A "sale or t�ans�fer" means the can�eyance of Real Property flr any
<br /> right, �Citle or in�eresfi in the Reai Property; whether �egal, beneficial or equi�kable; wh�th�r �oluntary or in�o�untary;
<br /> whether by outright safe, deed, insta[lment sale contrac�, land cantrac�, �ontract �or deed, leasehold interest w€th a
<br /> term great�r than three �3} years, IeaseWoption cvntra�t, Qr by sa[e, assignment, ar transfer o�any bene��cial interest in
<br /> �r to any land �trust ha�ding ti�le to the Real PrQp�rty, or by any o�ther methad vf canveyanc� of an interest in th� Real
<br /> �Property. [f any Trustor is a carp�ration, partnersh�p ar �imited liabili�y company, transfer alsv includes any change in
<br /> own�rsh'rp of more fihan�wen�y-five per�ent �2�°/0} o��he�o�ing stoc�, partnership interests ar limited liability company
<br /> lI��P�PS�Sr as the case ma�y be, af such Trustar. Howe�er, this option shall not be exercised by Lender i�such exercise
<br /> is prohibited by��deral law or by Nebraska law.
<br /> TAXES AND L}ENS. The fo[lowing pro�is€ons relatin� ta the �axes and liens on the Property are part Qf th�s Deed o�
<br /> Trust:
<br /> Paymen�. Trustor shal� pay when due tand in all e�ents prior ta delinquency� all taxes, specia[taxes, assessments,
<br /> charges {inc�uding water and sewer�, fines and impositians [evied agains�or on account af�he Prope�ty, and shal�
<br /> pay when due all claims f�r wark done on or for ser�ices rend�red ar materia� �urnished to the Prope��y. Trustor
<br /> shai! maintain the Property�ree of a�I liens having priority��er or equal to�he int�r�st of Lend�r under this Deed o�
<br /> Trust, ex�ept for �he i�en of taxes and assessments not due and except as otherwise pro�ided in �h�s C�eed of
<br /> Trust.
<br /> Right�v Contest. Trustor may withhold payment of any tax, assessmen�, or cia�m in connection with a g�od fa�th
<br /> dispufie o�er the obligatiQn to pay, so long as Lender's interest in the Prvperty is not jevpardiz�d. !f a lien arises or
<br /> is f�led as a r�sul� of nonpayment, Trustar shall within fifteen �15j days a�ft�r the lien arises or, �f a Cien is �iled,
<br /> with�n �if�een t15y days after Trustor has nvtice o�f th� �filing, secure the discharge ofi ths lien, �r if reques�ed hy
<br /> Lender, deposit with Lender cash or a suf�icient corpora�Ce surety�ond�r a�her security satis�act�ry to Lender in an
<br /> amount suffi�ient ta discharge the lien p�us any cos�s and attarneys' fees, ar ofiher charges that could accrue as a
<br /> resu�t of a forec�osur�or sal� under the iien, !n any�ontest, Trustor shall defend itse[f and Lender and shai{satisfy
<br /> any ad�erse judgment be�ore en�farcement against the Proper�y. Trustor shall name Lender as an additional obligee
<br /> under any sure�y�orad furnished in the contest proceedings.
<br /> E�idence vf Paymen�. Trustor shall upan demand furnish t� Lender sa��sfiactory ev�dence of paymen�o�f th� taxes
<br /> or assessments and shall au�khorize the appropria�e ga�ernmental officiaf to deliver�o Lender at any time a wri��en
<br /> statement of the ta�ces and assessments against�he Prvperty.
<br /> Nat�ce vf Constructian. Trustor shall noti�y Lender at least fif�een �15� days �efore any work is �ommenced, any
<br /> ser�ices are �urnished, or any ma�erials are supplied ta the Property, i#any mechanic's lien, mater�almen's lien, or
<br /> ather lien could be asser�ed ❑n account of the wark, ser�Eces, or mater�als. Trusta� will upon reques� o� Lender
<br /> furnish to Lender advance assurances sa�is�actory t� Lender that Trustor can and will pay the Gost o� su�h
<br /> impro�ements.
<br /> PR�PERTY DAMAGE iNSURANCE. The �allowing pra�isions relating �o insuring the Property ar� a part❑f this Deed of
<br /> Trust.
<br /> Maintenan�e of lnsurance. Trustor shall procure and maintain policies of �ire insurance with standard extended
<br /> �o�erage endorsements vn a replacemen� basis f�r the ful! insurable �alue co�ering al� improvements on the Real
<br /> Pr�perty in an amount sufficient to a�aid appliCation o� any cQinsurance c�ause, and ►rv�th a standard mor�gagee
<br /> c�ause in fa�ar af Lender. Trustor shall also prflcure and maintain comprehensi�e gene�-ai liability insurance in such
<br /> cav�rage amaunts as Lender may reques� vvith Trustee and Lender being named as additional insureds in such
<br /> liabi[ity insurance policies. Additionally, Trustor shalf maintain such other insuranc�, inc�ud'rng but nat limited to
<br /> hazard, bus�ness interruption, and boiler insurance, as �ende� may reasanably require. PaE�cies shal� be writt�n in
<br /> form, amounts, ca�erages and basis reasonab�y acceptable to Lender and issued by a campany ar companies
