<br /> and Liability Act�CERCLA,42 U.S.C.9601 et seq.},and all other federal,state and local�aws,regulations,
<br /> ordinances,court orders,attarney general opinions or interpreti�e letters concerning the publEc health,�afety,
<br /> we�fare,en�ironment ar a hazardaus sub�tance;and 42}Hazardaus Substance m�ans any toxic,radioacti�e or
<br /> hazardous material,waste,pol�utant or contaminant which has characteristics whi�h render the substan��
<br /> dangerous or patentiallydangeraustothe public heaith,safety,welfarevren�iranment.Theterm includes,
<br /> without limitati�n,any substances defined as"hazardaus ma�erial,""toxic substances,""hazardous waste"or
<br /> "hazardaus sub�tan�e"under any En�ironmenta!Law.
<br /> Trustor represents,warrants and agrees that:
<br /> A. Except as pre�iously dis�fosed and acknowledged in writing to Benefi�iary,no Hazardous Substan�e is
<br /> ar wifl be Iv�ated,stared or released�n or in the Property.This re�triction does n�t apply to small
<br /> quantities❑f Hazardous 5ubstances that are generally recognized to be appropriate for the narma�use
<br /> and maintenance of the Property,
<br /> B. Except as pre�iousiy dis�losed and acknowledged in wr+ting t�Beneficiary,Trustor and every tenant
<br /> ha�e heen, are, and sha11 rernain in ful� compliance with any appli�ab�e En�ironmental Law.
<br /> C. Trustnr shall irnm�diately notify Benef�ciary if a release❑r threatened release of a Hazardous Substanee
<br /> accurs on,underoraboutthe Prop�rtyorthere is a�ia(ation of any En��ror�rnental Law con�ernir�gthe
<br /> Praperty.In such an e�ent,Trustor shal!take all ne�essary remedial a�ti�n in accordance with any
<br /> En��ronmental Law.
<br /> D. Trustarshall immediateiy notify Benef'r�iary in writing as soan asTrustor ha5 reason ta belie�ethere is
<br /> any pending orthreatened in�esti�ation,elaim,or proceed�ng relating tathe re�ease orthreatened
<br /> release of an�Hazardous Substance ar the�iolation of any En�ironm�ntal Law.
<br /> 18, C�NDEMNATI�N.Trustor wil�gi�e Ben�ficiary prompt noti�e of any pending or threa�ened a�tion,by
<br /> private ar pub�ic entities to purchase ar take any or all of the Proper�y thraugh�ondemnation,eminent
<br /> domain,o�any other means.Trustor authorizes Beneticiary to inter�ene in Trustor'S name in any of the
<br /> abv�e described ac�ions or claims.Trustar assigns tc�Benefitiary the proceed�of any award vr claim fvr
<br /> damage�connec�ed with a condemnativn�r other taking of all or any part of the P��perty.Su�h p�oCeeds
<br /> shal{be can�idered payments and will�e applied as pro�ided in this Security Instrument.This assignment of
<br /> proceeds is subje�t to the terms of any prior mor�gage,deed af trust,security agreem�nt or other lien
<br /> document.
<br /> 19. INSURANCE.Trustor shall keep Pr�perty insured against Ioss by fire,f�aod,theft and other hazards and
<br /> risk�reasona�ly assvciated with the Prvperty due to its type and la�at�on.This insurance sha�l be maintained
<br /> in the amounts and for the periods that Beneficiary requires.What Beneficiary requires pursuan�to the
<br /> pre��ding two senten�es ean Change during the term vf the Secured Debt.The insurance carrier pra�iding the
<br /> insurance shall be�hvs�n by Trustor subject to Benefieiary's appro�al,whi�h shaf!not be unreasonably
<br /> wi�hheld.If Tru�tar fails tn rnaintain the c��erage described abo�e,Beneficia�y may,at Beneficiary's op�ion,
<br /> abtain�o�erage to pratect BenefiCiary's rights in the Praperty ac�ording to the terms of this Seeurity
