Box 627 <br />Grand Island, NE 68802 <br />1 <br />rn <br />C <br />z <br />co <br />C <br />RELEASE OF RESTRICTIVE COVENANTS <br />r> <br />c-; <br />N <br />CD <br />CJ <br />Record against: Lot One (1) Santa Anita Estates Subdivision in the City of Grand Island, Hall County, <br />Nebraska <br />Fri <br />C) <br />WHEREAS the Declaration of Restrictive Covenants, Restriction and Conditions <br />for Santa Anita Estates Subdivision in the City of Grand Island, Hall County, Nebraska <br />was executed on March 12, 1996, by Riverside Investment Inc., a Nebraska Corporation <br />and recorded on March 13, 1996, as document #96- 101840 against Lots One (1) through <br />Eighteen (18) in Santa Anita Estates Subdivision in the City of Grand Island, Hall <br />County, Nebraska (the "Covenants "); and <br />WHEREAS the property described as Lot One (1) Santa Anita Estates <br />Subdivision in the City of Grand Island, Hall County, Nebraska ( "Lot One ") was <br />previously conveyed by Riverside Investment Inc., a Nebraska Corporation, to Lawrence <br />J. Scheel and Marjorie E. Scheel, husband and wife as joint tenants, by Quitclaim Deed <br />on September 6, 1995, which Deed was recorded on September 11, 1995, as Document <br />#95- 106110; and <br />WHEREAS notwithstanding the fact that Riverside Investment Inc. did not own <br />Lot One on the date of executing or recording the Covenants and that Lawrence J. Scheel <br />and Marjorie E. Scheel as owners of Lot One on said dates did not execute the <br />Covenants, the recording of the Covenants against Lot One creates a cloud on the title to <br />Lot One; and <br />WHEREAS the Covenants may be changed or modified by vote of a majority of <br />the then owners of the Lots in said subdivision; and <br />WHEREAS the parties desire to cure the title defect by releasing the Covenants <br />against Lot One. <br />
