<br />TRUST DEED
<br />THIS TRUST DEED, made this day of October, 2015, by and between JUAN
<br />A. HERNANDEZ and MARIA I. DIAS HERNANDEZ, Husband and Wife, and NELLY M.
<br />HERNANDEZ DIAZ, a Single Person, hereinafter called "Trustor" whose address is
<br />1124 W. 3 Street, Grand Island, Nebraska 68801, and FRANCIS J. PIERSON and
<br />JEANNE M. PIERSON, Trustees, hereinafter called "Beneficiary" whose address is
<br />1950 W. Littleton Blvd., #205, Littleton, Colorado 80120 and MARK A. BECK,
<br />attorney at law, hereinafter called "Trustee" whose address is P.O. Box 10,
<br />Hastings, Nebraska 68902.
<br />WITNESSETH: That Trustor, in consideration of One Dollar ($1.00) and other
<br />valuable consideration receipt whereof is hereby acknowledged, grants, conveys,
<br />sells and warrants to Trustee, in trust, with power of sale, the property,
<br />situated in Hall County, Nebraska as described below:
<br />Lot Five (5), Block Thirteen (13), in Arnold and Abbott's Addition
<br />to the City of Grand Island, Hall County, Nebraska.
<br />The intention being to convey hereby an absolute title in fee simple,
<br />including all the rights of homestead and dower, together with all buildings,
<br />fixtures, improvements and appurtenances thereunto belonging; and all of the
<br />foregoing, together with said property are herein referred to as the "Property ".
<br />FOR THE PURPOSE OF SECURING performance of each agreement and covenant of
<br />Trustor herein contained and the payment of the principal sum of ONE HUNDRED
<br />FORTY -FIVE THOUSAND NINE HUNDRED AND NO /100 DOLLARS ($145,900.00), as evidenced
<br />by a promissory note bearing even date at the rates of interest thereon which may
<br />hereafter be paid or advanced under the terms of this Trust Deed; both principal
<br />sum and interest thereon being payable according to the terms set forth in said
<br />promissory note, reference to which is hereby made, at the holder's place of
<br />business, or at such other place as the holder may designate in writing, the
<br />final payment of principal and interest, if not sooner paid, shall be due and .
<br />payable on the 5th day of October, 2045.
<br />Trustor and Beneficiary covenant and agree as follows:
<br />1. Warranty of Title. Trustor is lawfully seized of the Property; it has good
<br />right and lawful authority to sell and convey the Property; the Property is free
<br />and clear of all liens and encumbrances except liens now of record; and Trustor
<br />will warrant and defend the title to the Property unto the Trustee and its
