Borrower shall pr�mptly give Lender written notice af any investigation,claim,demand, Iawsuit or other action by any go�ernmental or regu�atory agenc�or prxvate party in�ol�ing the Property and any Hazardous Substance or En�ironmental Law of which Barruwer has actual knowiedge.If Borrower learns,ar is natified by any go�ernmental ar regulatory authority, that any rema�al ar ather remediation of an�Hazardaus Substances affecting the Froperty is ne�essary,Barrawer shall promptly take all necessary remedial actions in accardance with Environm�nta�Law. As used in this paragraph l 5,"Hazardous 5ubstances"are thvse substanc�s defined as toxic or hazardous suhstances by En�ironmental Lavv and the faliowing substan��s:gasoiine,kero�ene,other flammable or taxic petroleum products,ta�ic pesticides and herhicides,W�latile solwents,materials containing asbesta5 or formaldehyde,and radioactive materials.As u�ed in this paragraph 1�,"Envirvnmental Law"mean�federal laws and laws of the jurisdiction where the Property is tocat�d that relate to health,safety vr environmental protection. Non-Unif�rm C4venants.Borrower and Lender further coWenant and agree as foll�ws: 17. Assignment of Rents. Sorrower uncanditionally assigns and transfers to Lender all the rents and re�enues of the Proper�y. Borrawer authari�es Lender or Lend�r's ag�nts to collect the rents and re�enues and h�reby directs�ach tenant of the Propert�to pay�he rents to Lender or Lender's agent�. However,priar to Lender's natice ta Borrower of Borrow�r`s�reach af any co�enant or agreement in the Security Instrument,Barrower shall colie�t and recei�e all r�nts and reWenues nf the Property as trustee for th�benefit of Lender and Borrower.This assignm�nt of rents canstitutes an absolute assignment and not an as�ignmen#for additional s�curity oniy. If Lender gi�es notice of breach to Barrower; �a}all rents recei��d by Barrower shall b�held by Borrower as trustee for hen��t of L�nder an1y,to be applied ta the sums secured by the Security Instrument; �b} Lender shall be entitled to colle�t and recei�e all of the rents of the Property; and�c}each tenan�of the �roperty sha11 pay all r�nts due and unpaid ta Lend�r or L�nder'�agent an Lender's vvritten d�mand to the tenant. Borrower has not executed any prior assi�nment�f the rents and has not and will not perform any act that would pre�ent Lender from exercising its rights under�his para�raph 17. Lender shall nat b�required to enter upon,tal�e control of ar main#ain the Property before or after gi�ing notice of breach to Borrower. Howe�er,Lender vr a judicially appointed recei�er may do so at any time there is a breach. Any application af rents shall nat cure or wai�e any default or invalidate any other right or remedy of Lender. This assignrnent of rents�f the Praperty shall terminate when the d�bt secured by the Security Instrurnent is paid in full. 1 S. Forecl�sure Procedure. If Lender requires immediate payment in full under paragraph 9,Lender may in�oke the power of sale and any other rernedies perrnitted by app�icab�e law.
