9 <br />w00 ' <br />11. Exclusions for grave spaces sold or dedicated and restriction to cemetery uses, including the <br />following: <br />(a) Terms and provisions of, and all matters which may be revealed by, the various <br />cemetery plats, including those which are recorded and any which pursuant to <br />applicable law may be effective although unrecorded, including but not limited to any <br />provisions contained in the plats that any partitions of the Property shall be used for <br />cemetery purposes only, any reservations therein of drives, driveways, pathways and <br />open areas and the overall effect of these plats in dedicating the land as cemetery; <br />(b) The right of parties and lot owners created by the instruments filed or recorded, either <br />with the cemetery corporation or cemetery operators, and/or filed in the office of the <br />recorder of deeds; <br />(c) The right of parties entitled thereto, to keep therein the bodies and remains of deceased <br />persons now interred, and the right and/or easement of lot owners and others over the <br />Property for the purpose of grave visitation; <br />(d) Statutory rights and powers of State and County in which the Property is located and of <br />the municipalities in or near which the Property is located, to control the use of the <br />Property as a cemetery. <br />12.
