200001650 <br />3. Either of the parties hereto, their heirs, successors or <br />assigns, shall have the right to do such work on said garage or driveway, <br />and make such other repairs thereon, as are reasonably necessary to <br />maintain the structure and driveway in a reasonably good condition, and <br />upon the completion of such repairs, the parties making such repairs <br />shall be entitled to recover from the other party one -half of the cost <br />thereof; provided, however, that the parties shall first agree in writing <br />as to the nature of the work, the cost thereof and who will actually do <br />the work. <br />4. The parties further agree that the garage door, garage door <br />mechanism, etc., on each parties' allocated garage space shall be the <br />exclusive responsibility of the party using that allocated space. <br />5. Should a party desire to expand the portion of the driveway <br />surface on their side of the garage, this expansion shall be at the <br />exclusive cost of the party who is expanding their side. <br />This agreement shall be deemed to be a covenant running with the <br />title to the land, and shall be binding upon the parties hereto, and upon <br />their heirs, successors, and assigns, so long as either of the above <br />described properties are used for residential purposes and the parties <br />desire to jointly share the garage, and provided, however, that the <br />easement for the driveway purposes as herein described may be released <br />at any time by appropriate agreement for that purpose, entered into <br />between the then owners of said lots, duly executed and acknowledged and <br />filed for record in the office of the Register of Deeds of Hall County, <br />Nebraska. <br />IT WITNESS WHEREOF, the parties hereto have signed the foregoing <br />agreement the day and year first above wr' ten. <br />Ca mey D. ss <br />arlene R.
