NE 68802 <br />201506345 North Interceptor Phase 2 Improvements <br />Agreement for Temporary Construction Occupancy <br />1/2 <br />AGREEMENT FOR TEMPORARY CONSTRUCTION OCCUPANCY <br />Agreement made and entered into by and between the CITY OF GRAND ISLAND, a municipal <br />corporation of the State of Nebraska, herein referred to as "City ", and Gary and Estel Ummel, herein <br />referred to as "Owner ", whether one or more. <br />Recitals <br />WHEREAS, the City intends to construct North Interceptor Phase 2 Improvements, on or adjacent <br />to property owned by Owner; and <br />WHEREAS, it may be necessary for the City, its officers, agents, employees, contractors, <br />subcontractors, and authorized representatives to temporarily enter upon, travel over, excavate, clear, <br />backfill, store materials upon, and otherwise use the lands herein described which are owned by Owner <br />during the aforementioned construction project. <br />NOW, THEREFORE, in consideration of the mutual promises and covenants contained within this <br />agreement, the parties agree as following: <br />One -time payment of $1500.00 <br />The contractor will remove existing wire fence on north side of property. <br />Contractor will place new woven wire fence on the south, east, and north sides of property. Barbed wire <br />fence may be substituted if the owner chooses. Contractor will coordinate with owner on type of fence. <br />Contractor will coordinate with owner on removal of existing wire fence (hauled off or left for owner). <br />Contractor will remove trees as requested by the homeowner and as required for construction. <br />Contractor shall coordinate with owner on all construction items at all times and ensure owner is satisfied <br />with the construction. <br />Contractor shall keep owner's drive free of dirt. <br />Section One <br />Right of Entry <br />Owner hereby grants to the City, its officers, agents, employees, contractors, subcontractors, and <br />authorized representatives the right to enter upon the following described real estate described as follows: <br />Temporary Access Easement - <br />The South 30.00 feet of the North 40.00 feet, except the West 195.00 feet and except the East <br />10.00 feet thereof, and the West 30.00 feet of the East 40.00 feet, except the North 10.00 feet <br />thereof, of Lot Two (2), TLST Spiehs Subdivision, in the City of Grand Island, Hall County, <br />Nebraska Said temporary utility easement contains a calculated area of 28,170 square feet or <br />0.647 acres more or less, as shown on the tract drawing dated 08/10/15, marked Exhibit A <br />attached hereto and incorporated herein by reference. <br />to do such work as may be necessary or appropriate fcrr the construction of North Interceptor Phase 2 <br />Improvements and related''facilities adjacent to such proplerty. Such right of entry shall include, but not be <br />limited to the right to enter upon, travel over, excavate, clear fences, drives, irrigation lines and other <br />improvements, backfill, store materials upon, and otherwise use the above described premises. <br />
