Vaughn and Jean <br />the 'Borrower "), gave a deed of trust to Norwest dated A <br />and recorded in the Office of the Register of Deeds for _ <br />t 31 , 1 9 9 5 as Instrument Number <br />r <br />whic constitutes a lien on real property located in <br />follows (the "Property "): <br />M. V a u g h n (whether one or more, <br />u g u s t 14, 1995 (the " Norwest Deed of Trust "), <br />Hall County, Nebraska on <br />5-105877 in Book - Page Hall County, Nebraska more particularly described as <br />Lot 43, Le Heights Fourth Subdivision To The City Of <br />Grand Island, Hall County, Nebraska. <br />Creditor has mayt�dFs 9m8aking a loan to the Borrower, secured by a deed of trust on the Property dated <br />December 12, (the "Creditor Deed of Trust "), in the principal amount of S 7 5 , 2 0 0. 0 0 and recorded in <br />the Office of the Register of Deeds for Hall County, Nebraska on Dec . 2 4 , 19 9 8 as Instrument <br />Number 9 8 -112 7 6 9 afewXXxxxxxx4%ftXxxxxxxxx <br />Norwest has agreed to execute and deliver this Agreement for the purpose of subordinating its interest in the <br />Property pursuant to the Norwest Deed of Trust to the interest of the Creditor in the Property pursuant to the Creditor Deed <br />of Trust <br />Agreement <br />NOW THEREFORE, in consideration of the premises and as an inducement to the Creditor to accept the Creditor <br />Deed of Trust, Norwest and Creditor agree as follows: <br />1. Norwest agrees to subordinate, and hereby does subordinate, the lien of the Norwest Deed of Trust in and <br />against the Property to the lien of the Creditor Deed of Trust in and against the Property. Norwest agrees that the <br />Creditor Deed of Trust shall have the same validity, force and effect as if executed, delivered, and recorded prior <br />to the date of execution of the Norwest Deed of Trust. <br />2. Neither Norwest nor Creditor: (i) makes any representation or warranty concerning the Property or any <br />other property of the Borrower or the validity, perfection or (except as to the subordination accomplished hereby) <br />priority of any lien thereon or security interest therein, or (ii) shall have any duty to preserve, protect, care for, <br />insure, take possession of, collect, dispose of or otherwise realize upon the Property or any other property of the <br />Borrower. <br />
