<br /> Campliance With En�ironmen�al Laws. Trustor represents and warr.an�s�a Lender�ha�: {'1� During the period of
<br /> Trustor's�wnership❑fi th� Prop�rty,there has been no use, generation, manufacture, storage,treatment,disposal,
<br /> release ❑r�hreatened re�ease ❑�f any Ha�a�-daus 5ubs�ance by any person on, under, abvut or from the P�aperty;
<br /> {2) T�ustar has n❑ knowledge ❑f, vr reasan to bel�eve that�here has been, except as previously disclosed to and
<br /> acknowledged by Lender in writing, {a� any breach vr vialativn af any En�ironrnenta� Laws; �1a} any use,
<br /> generatian, manufacture, storage, treatmen�, disposal, release or threatened r�leas� vf any Hazardaus Substance
<br /> ❑n, under, ab�ut or �rom fihe Property by any priar owners ar occupants ❑�f the Property, ar �c} any actual ❑r

<br /> Substance on, under, abou�or�rvm the Pr�perty; and ��} any such act��i�y sha[f �e conducted En compliance with
<br /> all app�i�al�le federai, sfiate, and �vca1 iaws, reguia�tions and ardinances, inc[uding withou� limitat�on all
<br /> En�ironmental Laws. Trus�or authorizes Lender and ifis agenfis t❑ enfier upan fihe Praperty �o mal�e su�h
<br /> inspections and tesfis, at Trus�or's expense, as Lender may deem appropria�e to determine compliance of �he
<br /> Prvperty wi�h this sect�on af the Deed ❑f Trus�. Any inspecti�ns �r tests made by Lender shall be ��r Lender's
<br /> purposes anly and shall nv�be construed tv �reate any respvnsibility or liability on the part of Lender to Trusfior or
<br /> to any o�her persvn. The representations and warran�ies contained herein are based ❑n Trus�o�-'s due diligence in
<br /> in�estigating the Praperty for Hazardaus 5ubstances. Trustar herehy �1� releases and wai�es any#uture c�aims
<br /> against Lender for indemnity ❑r contribution in the e�ent Trustor becomes liable fo� cleanup or other cas�s under
<br /> any such laws; and {�} agrees tv indemnify, defend, and hold harmless Lender against any and all claims, �osses,

<br /> Nuisan�e, Waste. TruSt�r shal! n�� cause, conduct or permit any nuisan�e nar comrni�, permit, ❑r suffer any
<br /> stripping of or was�e vn or ta the Praperty or any pvrtian o#the Properky. Without �imiting the generality o�F the
<br /> foregoing, Trustor will no�remo�e, ar grant t� any a�h�r par�y the �-igh�to remove, any#imber, minerals �including
<br /> oil and gas}, c�af,clay,scoria,soil, gra�el or rock products without Lende�-'s pri�r written consent.
<br /> Remo►►a!of imprv�ements. Trusto�-shalf not demolish or remv�e an��mprv�ements fram the Real Property without
<br /> Lend�r`s prior written consent. As a cond�tion to�he remv�al ❑f any Impra�ements� Lender may require Trusto�-ta
<br /> make arrangernen�s satisfactory �o Lender ta replace such [mpro�emenrts w�th Improvements ofi at Ieast equal
<br /> �alue. �
<br /> Lender's Right ta Enter. Lender and Lender's agents and r�presenta�ives may enter upan the Real Praper�y at a�l
<br /> reasonab�e �imes ta attend tv Lender's in�erests and t❑ inspect the Real Praperty for purpases o� Trustor's
<br /> compEiance with�he�erms and cvndi��ons o�this�eed of Trust.
<br /> Compiian�e with Go�ernmentai Requirernenfs. Trustor shall promptly comply wi�h ali laws, ardinances, and
<br /> regu[ations, now ❑r hereafker in effect, ❑f all ga�ernmental authorities applicahle �t❑ the use ar ❑ccupancy af the
<br /> Pro�erty. Trustvr may cvntest in gvod faith any such law, ordinance,o�regufatEon and withhoEd cvmpliance during
<br /> any proceeding, including appropriate appeals. s� long as Trustar has no�ified Lender in writing priar to da�ng sa
<br /> and so lang as, in Lender's sale apinion, Lender's interests in the Property are not jeapardized. Lender may require

<br /> Duty ta Pro�e�t. Trustor agrees neither�a abandon vr leave unattended �h� Property. Trustor shall da all ❑ther
<br /> acts, in addition to those acts set forth abo�e in this se��ion, which from the charac#er and use vf fihe Prvperty are
<br /> �-easonab�y necessary�❑prvtec�and preser��the Property.
