If the Lender issues a partial reconveyance <br />of this Trust Deed, the proceeds received therefor shall be <br />credited to the last installment of the indebtedness secured <br />hereby. <br />H. Conversion of Security. All right, title and interest <br />of Trustor in and to all extensions, improvements, betterments, <br />renewals, substitutes and replacements of, and all additions and <br />appurtenances to the property, hereafter acquired by, or released <br />to, Trustor or constructed, assembled or placed by Trustor on the <br />Premises, and all conversions of the security constituted <br />thereby, immediately upon such acquisition, release, <br />construction, assembling, placement or conversion, as the case <br />may be, and in each such case, without any further deed of trust, <br />conveyance, assignment or other act by Trustor, shall become <br />subject to the lien of this Deed of Trust as fully and <br />completely, and with the same effect, as though now owned by <br />Trustor and specifically described in the granting clause hereof, <br />but at any and all times Trustor will execute and deliver to <br />Trustee any and all such further assurances, deeds of trust, <br />conveyances or assignments thereof as Trustee or Beneficiary may <br />reasonably require for the purpose of expressly and specifically <br />subjecting the same to the lien of this Deed of Trust. <br />I. Security Agreement. This Deed of Trust shall be self - <br />operative and constitute a Security Agreement under the Uniform <br />Commercial Code of the Governing Jurisdiction, as amended from <br />time to time, with respect to the Personal Property; provided, <br />however, Trustor hereby agrees to execute and deliver on demand <br />and, if appropriate, to file with the appropriate filing officer <br />or office such security agreements, financing statements or other <br />instruments as Beneficiary may request or require in order to <br />impose or perfect the lien or security interest hereof more <br />specifically thereon. This Deed of Trust shall be self- operative <br />and constitute a Construction Security Agreement under the <br />Construction Lien Act of the Governing Jurisdiction or other <br />similar laws, as amended from time to time. <br />J. Governing Law. This Trust Deed shall be governed by the <br />laws of the State of Nebraska. If any provision or clause of the <br />Note and Trust Deed are declared to be unconstitutional or <br />illegal, invalid or unenforceable, it shall be deemed to be <br />separate and severable from the rest of the provisions, and the <br />intent is that the remaining portions of the document will remain <br />in full force and effect. This instrument cannot be waived, <br />changed, discharged or terminated orally, but only by an <br />instrument in writing signed by the party against whom <br />enforcement of any waiver, change, discharge or termination is <br />sought. <br />K. Interchangeable Terms. As used herein, Trust Deed means <br />the same as Deed of Trust; Note means the same as Trust Note or <br />Deed of Trust Note or Promissory Note; and that said words are <br />used interchangeability herein. The term "Trustor" and <br />"Borrower" shall include both the singular and plural, and when <br />the Trustor and Borrower are the same person(s), those terms as <br />used in this Trust Deed shall be interchangeable. <br />L. Other Documents. The undersigned has also executed <br />other Loan Instruments simultaneously with the Trust Note and <br />this document. The undersigned agrees that said Loan Instruments <br />survive the closing, and that a default violation of any one Loan <br />Instrument is a default or violation of all Loan Instruments, and <br />that as a result thereof, this Trust Deed can be foreclosed or a <br />default can be declared. <br />M. Liens and Encumbrances. Trustor hereby warrants and <br />represents that there is no default under the provisions of any <br />mortgage, trust deed, lease or purchase contract describing all <br />or any part of the Property, or other contract, instrument or <br />agreement constituting a lien or encumbrance against all or any <br />12 <br />
