<br />and the Beneficiary, National Bank of Commerce Trust and Savings
<br />Association, Lincoln, Nebraska, whose mailing address is P.O. Box
<br />82408, Lincoln, Nebraska, 68501(hereinafter "Lender ").
<br />THIS TRUST DEED IS A CONSTRUCTION SECURITY AGREEMENT UNDER THE
<br />NEBRASKA CONSTRUCTION LIEN ACT. IT SECURES AN OBLIGATION WHICH
<br />BORROWER HAS INCURRED CONTEMPORANEOUSLY HEREWITH FOR THE PURPOSE
<br />OF MAKING AN IMPROVEMENT ON THE REAL ESTATE DESCRIBED BELOW.
<br />THIS TRUST DEED CREATES, GRANTS AND CONSTITUTES A CONSTRUCTION
<br />SECURITY INTEREST IN THE REAL ESTATE DESCRIBED BELOW.
<br />FOR VALUABLE CONSIDERATION, including the indebtedness
<br />identified herein and the trust herein created, the receipt of
<br />which is hereby acknowledged, Trustor hereby irrevocably grants,
<br />transfers, conveys and assigns to Trustee, IN TRUST, WITH POWER
<br />OF SALE, for the benefit and security of Lender, under and
<br />subject to the terms and conditions hereinafter set forth, the
<br />real property, described as follows:
<br />Parcel 1: Lot Two (2), in Park Island Square
<br />Subdivision, in the City of Grand Island, Hall County,
<br />Nebraska
<br />Parcel 2: Lots One (1) and Two (2), in Park Island
<br />Square Fifth Subdivision, in the City of Grand Island,
<br />Hall County, Nebraska;
<br />(the "Property ") , together with all buildings, improvements,
<br />fixtures, streets, alleys, passageways, easements, rights,
<br />privileges and appurtenances located thereon or in anywise
<br />pertaining thereto, and the rents, issues and profits, reversions
<br />and remainders thereof: all proceeds of the conversion voluntary
<br />or involuntary, or any of the foregoing into cash or liquidated
<br />claims, including, without limitation, proceeds of insurance and
<br />condemnation awards; and such personal property that is attached
<br />to the improvements so as to constitute a fixture, including, but
<br />not limited to, heating and cooling equipment; all of which,
<br />including replacements and additions thereto, is hereby declared
<br />to be a part of the real estate secured by the lien of this Trust
<br />Deed and all of the foregoing being referred to herein as the
<br />"Property" or "Trust Estate ".
