201505397 WHEREAS, the Deed of Trust was also accompanied by a Promissory Note payable by Trustor to Beneficiary; and WHEREAS, T. W. Ziller Properties, L.L.C., seeks to transfer the obligation imposed by the Deed of Trust and Note in the above- described property; and WHEREAS, J & B Rentals, L.L.C., a Nebraska limited liability company, for the consideration of One Dollar ($1.00) and Other Valuable Consideration, agrees to assume the obligations imposed upon T. W. Ziller Properties, L.L.C., as Trustor in the Deed of Trust dated December 14, 2012, and filed on December 17, 2012, as well as the obligations due and owing on the Note made contemporaneously therewith. IT IS AGREED BY AND BETWEEN THE PARTIES AS FOLLOWS: That for the consideration of One Dollar ($1.00) and Other Valuable Consideration, J & B Rentals, L.L.C., assumes the Deed of Trust recorded as Document 201210718 given by T. W. Ziller Properties, L.L.C., a Nebraska corporation, Trustor, and John 13. McDermott, Attorney at Law, as Trustee and Kenneth J. Kotinek, Trustee of the Kenneth J. Kotinek Revocable Living Trust dated May 2, 2008, and Elena M. Kotinek, Trustee of the Elena M. Kotinek Revocable Living Trust dated May 2, 2008, and further agrees to assume all liabilities and obligations thereunder. Specifically, J. & B Rentals, L.L.C., does hereby assume and agree to pay the obligations secured by such Deed of Trust according to its terms and those of the Note accompanying it. xxxg 29 Dated this xxftigax day of Thomas W.
