<br /> Assignment may be used interchangeably �n singu�ar or plural farm and the ward "B�rrawer"
<br /> shall m�an "each Borr�wer and an� subsequent av�n�r ar flvvners af the Property or any part
<br /> thereof or�nterest therein," the vvard"Lender" shall mean "Lend�r and any subse�u�nt h��der �f

<br /> by the L�an Agreement, the word "Property" shall include any par�ion af the Pr�per�y and any
<br /> interest therein, th� phrases "attarneys' fees", "legal fees" and "counsel fees" sha11 include any
<br /> and all attorney's, paralegal and law ��erk fees and disbursements, including, but not limited ta,
<br /> f��s and disbuxs�ments at the pre-trial, trra� and appel�ate levels incurred or paid b� Lender in
<br /> protecting its interest in the Propert�ry the Leases and the Rents and enforcing its rights
<br /> hereunder; Whenever the cor�text ma� require, any pronouns used herein shall include the
<br /> correspanding mascu�ine, feminine or n�uter farms, and the singular f�rm of n�uns and pr�nouns
<br /> shall inc�ud�the plural and vice versa.
<br /> Section 5.4 Inapulicable Provisians. If any term, covenant or conditian of
<br /> this Assignrnent is held to be inva�id, xl�egal ar unenforceai�le in any respect, this Assignment
<br /> sha�I be construed without such provision.
