<br /> Appl�cab�e Law perm��s Lender to make such a charge. Unless an agreement�s made�n writing or

<br /> in�erest or earnings�n�he Funds. Barrawer and Lender can agree�n writ�ng, however, ��.at�n�eres�sha��be

<br /> �f there is a surpius of Funds he�d in escraw, as d�fined under RESPA, Lender shall ac�oun��o Borrower far
<br /> the excess i�.nds in accardance with RESPA. �f there is a shor�age�f Funds he�d in escraw, as defined under
<br /> R.ESPA, I.ender shai�not�fy Borrower as required b�r RESPA, and Borrow�r shall pay�a Lend��r the amaun�
<br /> necessary to make up�he shar�age in accardan�e wi�h RESPA, bu� in no more than 12 m�nthly paymen��. �f
