3 201504214 STERLING ESTATES FOURTH SUBDIVISION, the Subdivider hereby consents and agrees with the City of Grand Island, Nebraska, as follows: 1. Paving. The Subdivider agrees to pave Ebony Lane, Norseman Avenue, Sunrise Avenue and Monarch Avenue in accordance with plans and specifications approved by the City's Director of Public Works, and subject to the City's inspection. If the Subdivider fails to pave Ebony Lane, Norseman Avenue, and Sunrise Avenue, the City may create a paving district to perform such work. The Subdivider agrees to waive the right to object to the creation of any paving district for Norseman Avenue and Ebony Lane where they abut the subdivision. 2. Water. Public water is available to the subdivision and the Subdivider agrees to extend, connect and provide water service to all lots in the subdivision in accordance with plans and specifications approved by the Director of Public Works, and subject to the City's inspection. The Subdivider shall be responsible for the removal of any water services fronting on to a lot that are not used at the time structures said lot are connected to the City Water System. Removal of water service shall include capping the service at the main. 3. Sanitary Sewer. Public sanitary sewer is available to the subdivision and the Subdivider agrees to extend, connect and provide sanitary sewer service to all lots in the subdivision in accordance with plans and specifications approved by the Director of Public Works, and subject to the City's inspection. A connection fee of Six Thousand One Hundred Sixty -Seven and 25/100 Dollars ($6,167.25) is due upon the execution of this agreement. The remainder of the connection fee will be paid using the same pro -rata formula as additional parcels receive final subdivision approval.
