3 <br />201504214 <br />STERLING ESTATES FOURTH SUBDIVISION, the Subdivider hereby consents and agrees with <br />the City of Grand Island, Nebraska, as follows: <br />1. Paving. The Subdivider agrees to pave Ebony Lane, Norseman Avenue, <br />Sunrise Avenue and Monarch Avenue in accordance with plans and specifications approved by the <br />City's Director of Public Works, and subject to the City's inspection. If the Subdivider fails to pave <br />Ebony Lane, Norseman Avenue, and Sunrise Avenue, the City may create a paving district to <br />perform such work. The Subdivider agrees to waive the right to object to the creation of any paving <br />district for Norseman Avenue and Ebony Lane where they abut the subdivision. <br />2. Water. Public water is available to the subdivision and the Subdivider agrees <br />to extend, connect and provide water service to all lots in the subdivision in accordance with plans <br />and specifications approved by the Director of Public Works, and subject to the City's inspection. <br />The Subdivider shall be responsible for the removal of any water services fronting on <br />to a lot that are not used at the time structures said lot are connected to the City Water System. <br />Removal of water service shall include capping the service at the main. <br />3. Sanitary Sewer. Public sanitary sewer is available to the subdivision and the <br />Subdivider agrees to extend, connect and provide sanitary sewer service to all lots in the subdivision <br />in accordance with plans and specifications approved by the Director of Public Works, and subject to <br />the City's inspection. A connection fee of Six Thousand One Hundred Sixty -Seven and 25/100 <br />Dollars ($6,167.25) is due upon the execution of this agreement. The remainder of the connection <br />fee will be paid using the same pro -rata formula as additional parcels receive final subdivision <br />approval. <br />
