(b) Financing Statements. Trustor authorizes Beneficiary to prepare and file <br />such financing statements and take such other action to perfect and continue <br />Beneficiary's security interest in the Property, and agrees to execute any and all <br />documentation and take such other actions as may be requested by Beneficiary for such <br />purposes. In addition to recording this Deed of Trust in the real property records, <br />Beneficiary may, at any time and without further authorization from Trustor, file <br />counterparts, copies or reproductions of this Deed of Trust as financing statements. <br />Trustor shall pay to Beneficiary on demand any and all expenses, including attorneys' <br />fees and expenses, incurred or paid by Beneficiary in perfecting, continuing, and <br />protecting its interest in the Property and in enforcing its rights hereunder with respect to <br />the Property. Trustor agrees that the requirement of reasonable notice under the UCC <br />shall be met if such notice is given at least ten (10) days before the time of the sale or <br />disposition (provided, however, that this sentence shall not be construed to prohibit a <br />shorter notice period, if commercially reasonable under the circumstances or otherwise <br />permitted by the UCC). <br />16. Fixture Filing. From the date of its recording, this Deed of Trust shall be effective <br />as a financing statement filed as a fixture filing with respect to all Property which now is or <br />hereafter becomes fixtures related to the Land. For this purpose, the following information is set <br />forth: <br />(a) Name and address of Debtor: <br />FreightCar Rail Services, L.L.C. <br />Two North Riverside Plaza, Suite 1300 <br />Chicago, IL 60606 <br />(b) Name and Address of Secured Party: <br />Grand Island Area Economic Development Corporation <br />123 North Locust Street, Suite 201 B <br />Grand Island, NE 68801 <br />(c) This document covers goods which are or are to become fixtures. <br />(d) Description of Land: See Exhibit "A ". <br />(e) Owner of Record of Land: Debtor. <br />(f) This Financing Statement covers Proceeds. <br />(g) Products of the Collateral are also covered. <br />201504188 <br />17. Requests for Notice. Trustor hereby requests a copy of any Notice of Default <br />and any Notice of Sale hereunder be mailed to Trustor at Trustor's address set forth in <br />Section 18 of this Deed of Trust. While hereby expressly reserving the priority of this Deed of <br />Trust as established by law, Trustee and Beneficiary hereunder request that a copy of any <br />Notice of Default and any Notice of Sale under any deed of trust recorded against the Property <br />either prior to, or subsequent to the date this Deed of Trust is recorded be mailed to each at the <br />addresses set forth in Section 18 of this Deed of Trust. <br />9 <br />
