<br /> effe�t as pro�ided in the terms of the 5ecured Debt.Trustor agrees to pay alf costs and expenses in�urred by
<br /> Benefi�iary in�olie�ting,enforcing or prote�ting Benefi�iary's ri�hts and reme�Ees under this Seeurity
<br /> Instrument.This amount may inc�ude,bu�is not lim�ted ta,attorneys'fees,cvurt casts,and other legal
<br /> expenses.This 5ecurity Instrument shall remain in effect until released.Trustor agrees to pay for any
<br /> recardation�osts�f su�h release.
<br /> '17. ENVIR�NMENTAL LAWS AN�HAZARD�US SVBSTANCES.As used in thi�se�t�on,��}
<br /> En�i�anm�nta�Law m�ans,withaut l�mitation,the�omprehen5i�e En�ironmental Respon�e,Compensation
<br /> and Liabil�ty A�t�CERCLA,42 U.S.C.96�1 et s�q.},and a!I other federai,state and Ivcal laws,regulat�ons,
<br /> ordinan�es,court orders,attorney general opinions or interpreti�e ietters concerning the public health,safety,
<br /> welfare,en�ironment or a hazardous substance;and�2}Hazardous Su�stan�e means any toxic,radioa�ti�e or
<br /> hazardous material,waste,po�lutant or cantaminant which has characteristics which render the su�stance
<br /> dangerous or potentialiy dangeraus to�he publie heaith,safety,welfare or en�ironment.The term in�Eudes,
<br /> withvut limitatian,any substan�es defined as"hazardous material,""toxic substan�es,""hazardous waste"ar
<br /> "hazardaus substan�e"under any En�ironmental Law.
<br /> Trustor represents,warrants and agrees that:
<br /> A. Ex�ept as previously disclosed and a�kno►rvl�dged in writin�to Benefi�iary,no Hazardous Substance is
<br /> or will be Io�ated,sta�ed or released on or in the Pr�perty.Th�s restriCtian does not apply t�small
<br /> quantities of Hazardaus Su�stan�es that are generally recognized ta be apprapriat�for the normal use
<br /> and maint�nance af the Property.
<br /> 6. Ex�ept as pre�Eau�ly disclvsed and a�knvwEedged in writing to B�neficiary,Trustor and e�ery tenant
<br /> have been, are, and sha1� remain in fuil compl�ance with any applicable En�ironmental Law.
<br /> C. Trustor shall immediately not�fy genefieiary if a release or threatened release of a Hazardous Substan�e
<br /> oc�urs on,under or a�out the Prvperty or there is a�iolation af any En�ironmental Law con�erning the
<br /> Property.!n su�h an e�ent,Trustor shaEl take al1 necessary remediai a�tion in a��ordanee with any
<br /> En�i�onm�ntal Law.
<br /> D. Trustor shall immed�ately notify Beneficiary in writing as so�n as Trustor has reason t��e�ie�e there is
<br /> any pending or threatened in�estigation,c�aim,ar proceeding relating tv the release or threatened
<br /> release of an�Hazardous 5ubstance or th��iolation of any En�iranmental Law.
<br /> "18. C�NDEMNATI�N.Trustor will gi�e geneficiary prompt notice of any pending or threatened action,by
<br /> pr�vate or publtc�ntities ta pur�hase or take any or al1 of the Property thraugh condemnativn,eminent
<br /> domain,ar any other means.Trustor authorizes Beneficiary ta inte�vene�n Trustvr's name in any of the
<br /> a�o�e des�ribed a�tions or��aims.Trustor assigns to Benefi�iary the proceeds af any award or�laim for
<br /> damages connected with a candemnation ar other taking of all ar any part of the Praperty.Such pro�e�ds
<br /> shall be considered payments and will be applied as pro�ided in this Se�urity Instrumerrt.This assignment of
<br /> proc�eds is subj��t to the terms of any prior mortgage,deed af trust,security agreement or other lien
<br /> document.
<br /> �9. lNSURANCE.Trusta�shall keep Property insured against Ioss by fire,flaod,th�ft and ather hazards and
<br /> risks reasonably associated with the Property due to its type and Iacation.This insuran�e sha11 be maintained
<br /> in the amaunts and fvr the periods that genefi�iary requires.What Beneficiary requires pursuant to the
<br /> preCeding twv senten�es�an change during the term of the 5ecured Debt.The insuran�e carrier pro�iding the
<br /> insurance shall be�hosen by Trustor 5ubject to 6enefi�iary's appro�al,which shall not be unreasona�ly
<br /> wi�hheld.!f Trustvr fails to maintain the eo�erage described a�o�e,Benefieiary may,at Ben�ficiary's option,
<br /> obtain co�erage to pratect Beneficiary's rights�n the Property a�evrding to the terms of this 5e�urity
<br /> Instrument.
