Re: The South Forty Feet (S40') of Lot Thirteen (13), Block Twenty -Nine (29), in Highland Park, an Addition to the City of Grand Island, Hall County, Nebraska, and a strip of land Twenty feet (20') in width, formerly a part of Waugh Street, lying adjacent to the South line of said Lot 13, more particularly described as follows: Beginning at the Southwest corner of said Lot 13, running thence South on the prolongation of the East line of said Lot 13, Twenty feet (20'); running thence West parallel to the South line of said Lot 13, One Hundred Forty feet (140'); running thence North on the prolongation of the West line of said Lot 13, Twenty feet (20') to the Southwest corner of said Lot 13; running thence East along the South line of said Lot 13, One Hundred Forty feet (140') to the point of beginning. Bernadine J. Elrod, being first duly sworn, deposes and states that the Last Will and Testament of Richard H. Eby, dated March 21, 2012, granted me the right to live in the above - referenced real estate, for as long as I am able or desire to reside there. The Will further stated that the home was not to be sold during the time that I reside in the home. Richard H. Eby died on February 21, 2015, and his estate is being probated in Hall County Court, as Case No. PR 15 -43. I, Bernadine J. Elrod, hereby waive and release any right I may have to reside in the above referenced property, and consent to the sale of the property by the Personal Representative of the Richard H.
