<br /> replacements,and maintenan�e necessary to presetve�ts�alue.
<br /> �omp�iance Wi�h En�i�ronmen#al Laws. Trustor represents and wart-an�s'�o Lender�hat: �'1} During the periad of
<br /> Trustor's ownership of�he Property, �here has been no use,generation, manufa��ure,storage, �rea�men�,disposal,
<br /> release or threatened reiease of any Hazardous Substance by any person on, under, about ar fr�m the Praperty;
<br /> ��} Trustor has no knowledge of, or�-eason tQ belie�e that there has been, except as pre�iously disclosed ta and
<br /> acknowledged by Lender in writing, �a� any breach ❑r �iolation of any Environmen#�I Laws, �b} any use,
<br /> gene�-ation, manufacture, storage, treatment, disposai, release ❑r thr�atened release of any Hazardous Substance
<br /> on, under,-about o��rom the Property by any prior owners or o�cupan�s vf the Property, ❑r tc} any ac�ual or
<br /> threatened li�igatian or claims af any kind by any person rela�ing to such mat�ers; and �3} Excep� as pre�iously
<br /> dis�lased to and a�knowledged by Lender in writing, �a} neither Trustor nar any�enant, c�n�ractor,agent ar o�her
<br /> authori�ed us�r c�f the P�aper�y shail use, generate, manufac�ure, store, trea�, dispos�o�or release any Ha2ardous
<br /> Substance on, und�r, abou�or fr�m the Proper�y;and �b} any such acti�ity shall be conduc�ed in compliance with
<br /> a�l applicable �ederal, sta�e, and local l�ws, regula��ons and ordinances, including wifhout Ifmitation a1�
<br />� En�ironmental Laws. Trustor authorizes Lender and its agents to en�er upon the Property to make such
<br /> inspe�tians and �ests, at Trusto�-'s expense, as Lender- may deem appropr�ate to de�erm�ne compliance of �he
<br /> Property with �his s��tian o�the Deed of Trust. Any inspec#ions or �es�s made by Lende� sha�i be�or Lender's
<br /> purposes on�y and shall not be cons#rued �o crea�e any responsibil��y or l�ability on the part of Lender to Trus#o�ar
<br /> tv any vther person. The representations and warran#ies con�ained herein are based vn T�ustor's due diligence in
<br /> in�estiga�ing the Proper�y�or Hazardous Substances. Trus�or hereby ��} rsl�ases and wai�es any future c�aims
<br /> against Lender for indemnity or con�ributian in the ��en�Trus�or be�omes liable for cleanup o�other cos�s under
<br />_ any such laws; and ��} agrees ta indemnify, de�fend, and hold harmless Lender agains�any and all claims, �osses,
<br /> liabiiities, damages, penalties, and�xpenses which Lender may dire�fly or ind�rec#ly sustain or su�fet�resu�ting frvm
<br /> a breach o�this sectian of the Deed o�Trus� vr as a �ons�quence of any use, generation, manufacture, storage,
<br /> disposa�, release or�hr�atened release accurring p�io��a Trustor's ownership or interes�in�he Property,whether or
<br /> not �he same was vr should ha�e been knawn to Trustvr. The pro�isi�ns of this sectian of th� Deed a�Trust,
<br /> inciuding the obiigation ta indemni�fy and defend,shall sur�i�e the payment vf the Indebt�dness and the satisfaction

<br /> Nuisance, Waste. Trustor sha�( not cause, conduct o�- permit any nuisance nor commi�, permi#, or suifer any
<br /> stripping of❑r waste on or to the Property or any por�ivn ofi the Property. V11i�hout lim�ting �he genera�ity❑f�he
<br /> � fo�egaing, Trus�or wiil not remo�e, or gran�to any�ther parky the right�o remo�e, any t�mbe�-, minerals�including
<br /> vii and gas},caal,clay, scoria, soil, gra�el or rock praducts without Lender's pr�ar writ�en cansen#.
<br /> Remo�ai of Impro►►ements. Trus�or shall no�demofish or rema�e any Impro��ments fram fihe Real Proper#y without
<br /> Lender's prior written�onsent. As a cond�tian�o the�ema�al vf any�mpro�ements, Lender may requ�re Trustor ta
<br /> make arrangements satisfa�tory �o Lende�- to rep[ace such �mpro�ements with Impro�ements o� at feast �qual
<br /> �a�ue.
<br /> Lender's Right to �nter.. Lender and Lender's agen�s and representa�i�es may enter upon the Real Proper-ty a# a�l
<br /> reasanab�e �imes �to attend �a Lender's interests and to �nspec� the Rea� Property for purpvs�s of Trus�or's
<br /> compliance wi�th the terms and candi�ions of this Deed o�Trus�.
<br /> Compliance with Gvrrernmen�ai Requirements. Trus�vr shai[ p�omptly compiy with al! laws, ordinances, and
<br /> r�gufafiions, naw or herea�ter �n effect, vf all go�ernmenta� authorities applicable #o �he use or occupancy of the
<br /> Proper�y. Trustor may contes#in gaod fa��h any such �aw, ordinance, ❑r regula�ian and wi�hhv�d camp�iance during
<br /> any proceeding, including appropriate appeals, so long as Trustor has notifed Lsnder in wri�ing p�ior to do�ng sa
<br /> and so long as, in Lender's snle apin�on, Lender's in�eres�s in the Proper�y are no#je�pardized. Lender may require
<br />� Trustor�v post adequa#e securi�y or a sure�y bond, reasonably satisfactory to Lender,to pr��ect Lender's in#erest.
