GALLES, is the <br />Successor Trustee under a Deed of Trust made and entered into on or about March 5, 2012, by and <br />between KEITH W. TINNELL and MONIQUE D. TINNELL, husband and wife, Trustors, and <br />U.S. BANK TRUST COMPANY, NATIONAL ASSOCIATION, Trustee, MORTGAGE <br />ELECTRONIC REGISTRATION SYSTEMS, INC., as nominee for CharterWest National <br />Bank, Beneficiary. Said Deed of Trust was recorded on March 6, 2012, as Instrument No. 2012- <br />01753 of the Mortgage Records of Hall County, Nebraska. Said Deed of Trust having been assigned <br />by virtue of an Assignment dated June 18, 2013 to U.S. BANK NATIONAL ASSOCIATION, and <br />which was filed for record on June 27, 2013, as Instrument No. 2013 -05130 of the Mortgage Records <br />of Hall County, Nebraska. GREGORY L. GALLES was appointed Successor Trustee by virtue of a <br />Substitution of Trustee dated July 14, 2014, and recorded January 16, 2015 as Instrument No. 2015- <br />00353 in the Office of the Register of Deeds for Hall County, Nebraska. GREGORY L. GALLES, <br />Grantor, in consideration of the sum of Sixty -One thousand One Hundred One and 00 /100 Dollars <br />($61,101.00) and other good and valuable consideration received from NICE HOMES, INC., does <br />hereby grant, bargain, sell, convey and confirm unto NICE HOMES, INC., (hereinafter "Grantee" <br />where appropriate), the following - described real property in Hall County, Nebraska, to wit: <br />LOT ONE (1), BLOCK THIRTY FIVE (35), CHARLES WASMERS ADDITION TO <br />THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA. <br />to have and to hold the above - described premises together with all tenements, hereditaments and <br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever. <br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns: <br />1. That KEITH W. TINNELL and MONIQUE D. TINNELL, as Trustors, failed to pay to <br />Beneficiary payments which were contractually due, and the Grantor, at the request of the <br />Beneficiary, elected to declare the entire unpaid principal balance, together with interest <br />thereon at once immediately due and payable. <br />2. That a Notice of Default as required by § 76 -1006 was filed by Grantor on January 16, 2015, <br />as Instrument No. 2015 -00354 in the Office of the Register. of Deeds of Hall County, <br />Nebraska. A copy of said Notice of Default was thereafter mailed to all parties entitled to <br />notice, pursuant to said Deed of Trust and in compliance with § 76 -1008, R.R.S. Nebraska. <br />3. That the Trustors failed to cure the default referenced in the Notice of Default within 30 days <br />after filing of the Notice of Default. <br />4. That a Notice of Trustee's Sale was filed by Grantor on February 27, 2015, as Instrument No. <br />2015 -01166 in the Office of the Register of Deeds of Hall County, Nebraska. A copy of said <br />Notice of the time and place of the sale was thereafter mailed to all parties entitled to notice <br />pursuant to said Deed of Trust and in compliance with § 76 -1008, R.R.S.
