Jean Yost ( "Affiant ") deposes and states as 10 • <br />follows: <br />1. Affiant is the sole owner of the property legally described as the West 36 Feet of <br />Lot 7 and all of Lot 8, Block 1, Pleasant View Third Addition to the City of Grand Island, Hall <br />County, Nebraska (the "Property "). <br />2. As security for a loan in the principal amount of $51,000.00 (the "Loan), Robert <br />H. Yost ( "Robert") and Affiant, husband and wife, as trustors, executed a deed of trust with <br />Superior Mortgage, Inc., as Beneficiary and Stewart Title Guaranty Company as Trustee dated <br />and recorded against the Property on April 8, 1983, as Instrument No. 83- 001705 (the "Deed of <br />Trust "). <br />3. Affiant desires and requests the foregoing Trustee to issue a Deed of <br />Reconveyance releasing the Property from the lien of the Deed of Trust and in consideration <br />thereof, warrants, represents and guarantees to Trustee as follows: <br />A. Affiant is in actual possession of the Property and has a continuous and unbroken <br />record chain of title to the Property for a period of more than 23 years. <br />B. Affiant is unaware of the actual date the Loan was paid in full, but is certain the Loan <br />was paid in full before May 5, 2004 (which was the date of Robert's death) as Robert <br />made all of the Loan payments and no payment has been made on the Loan since <br />Robert's death. <br />C. Affiant has never received a notice of delinquency, notice to cure, notice of default or <br />any other communication from Superior Mortgage, its successors in interest or <br />assigns indicating in any manner that the Loan is unpaid or delinquent. <br />D.
