1. He is currently a member of the Nebraska State Bar Association and has been
<br />a member of the Nebraska State Bar Association continuously since September 22, 1980.
<br />2. In a Deed of Trust dated June 13, 1993, recorded on June 18, 1993, as
<br />Document No. 93- 105138, executed by Allen J. Schoenstein and Tina L. Schoenstein as
<br />trustor, he was identified as the trustee and Home Federal Savings and Loan Association
<br />of Grand Island was identified as the beneficiary.
<br />3. Such Deed of Trust affected that real estate described as Lot One (1) in Block
<br />Seventy -Six (76) in Wheeler and Bennett's Third Addition to the City of Grand Island,
<br />Hall County, Nebraska.
<br />4. After having given Notice of Default that was filed of Record on February 16,
<br />1999, as Instrument No. 99- 101723 and thereafter publishing Notice of Sale and
<br />otherwise complying with the requirements of the Nebraska Trust Deeds Act, the
<br />undersigned did on May 5, 1999, execute and deliver a Trustee's Deed to Richard J.
<br />Strehle and Helen K. Strehle, as joint tenants and not as tenants in common, as the
<br />successful bidders at the time and place specified for that sale.
<br />5. Such Trustee's Deed described in Paragraph 5 of this Affidavit was not
<br />recorded by the grantees therein described until May 13, 1999, when it was recorded as
<br />Instrument No. 99- 104899.
<br />6. By error and inadvertence, Home Federal Savings and Loan Association of
<br />Grand Island, did cause a Deed of Reconveyance to be filed of record on May 12, 1999,
<br />as Instrument No. 99- 104899 notwithstanding that on May 5, 1999, the Trustee's Deed
<br />operated to convey to the purchasers, without right of redemption, the trustee's title and,
<br />effectively, foreclosed by power of sale all right, title, interest and claim of the trustors
<br />and their successors in interest and of all persons claiming by, through or under them, in
