- 2 - <br />20150289 <br />tract drawing dated 07/08/14, marked Exhibit I attached hereto and incorporated herein by <br />reference. <br />Located in part of the Northeast Quarter (NE1 /4) of Section Twenty -four (24), Township Ten (10) <br />North, Range Ten (10) West of the 6th P.M., Hall County, Nebraska, and more particularly <br />described as follows: Commencing at the Northeast Corner of said Northeast Quarter; thence on an <br />assumed bearing of S00 °47' 14 "E, along the East line of said Northeast Quarter, a distance of 950.00 <br />feet; thence S87 °53' 14 "W, parallel to the North line of said Northeast Quarter, a distance of 105.84 <br />feet to a point on the West right -of -way line of U.S. Highway 281 and the Southeast Corner of a <br />tract of land recorded in instrument No. 200602787, Hall County Register of Deeds, Grand Island, <br />Nebraska, said point also being the Point of Beginning; thence along the South line of said tract of <br />land to the intersection of said South line and a line parallel to and 25.00 feet West of the West <br />right -of -way line of U.S. Highway 281; thence along said line parallel to and 25.00 feet West ofthe <br />West right -of -way line of U.S. Highway 281, to a point on the North line of said tract of land; <br />thence along said North line of a tract of land to the West right -of -way line of U.S. Highway 281; <br />thence along said West right -of -way line to the Point of Beginning. Said utility easement contains <br />an approximate area of 12,292 square feet or 0.28 acres more or less, as shown on the tract drawing <br />dated 07/08/14, marked Exhibit 3 attached hereto and incorporated herein by reference. <br />together with the following rights, namely, unrestricted ingress and egress under, over, and across such <br />land for the purpose of exercising the rights herein granted, to excavate and refill ditches and trenches, and <br />the right to clear and keep clear of trees, roots, brush, hedges, undergrowth, and other obstructions from the <br />surface of such tracts interfering with the location, construction, inspection, repair, replacement, removal, <br />and maintenance of such utilities. Any such utilities and appurtenances placed upon, over, and under such <br />tracts of land shall remain the property of the Grantee and may be removed or replaced at any time. <br />The Grantors, for themselves, their heirs, executors, administrators, successors, and assigns, hereby <br />covenant that no buildings, fences, or structures shall be erected or permitted on said tract and that the <br />easement herein granted shall run with the title to such tract of land and be binding upon the Grantors, their <br />successors and assigns. The existing pole sign located on the easement described in Exhibit can remain <br />located in the permanent easement. <br />
