20150275 <br />8.12 Survival. All agreements, representations, warranties and covenants made in <br />this Deed of Trust shall survive the execution and delivery of this Deed of Trust and the other <br />Loan Documents. <br />8.13 Conflict of Terms. In the event of any material conflict between the terms of this <br />Deed of Trust and the Loan Agreement, the terms of the Loan Agreement shall control. <br />8.14 Time of the Essence. Time is of the essence with respect to this Deed of Trust. <br />8.15 Headings. The Article, Section and Subsection titles hereof are inserted for <br />convenience of reference only and shall in no way alter, modify or define, or be used in <br />construing, the text of such Articles, Sections or Subsections. <br />8.16 Entire Agreement. This Deed of Trust and the other Loan Documents embody <br />the entire agreement and understanding between Beneficiary and Grantor and supersede all <br />prior agreements and understandings between such parties relating to the subject matter hereof <br />and thereof. Accordingly, the Loan Documents may not be contradicted by evidence of prior, <br />contemporaneous or subsequent oral agreements of the parties. There are no unwritten oral <br />agreements between the parties. <br />8.17 Counterparts.
