4 <br />201502484 <br />the subdivision, the Subdivider agrees to install public sidewalks within one year of the completion <br />of such street improvement district in accordance with the City of Grand Island Sidewalk Policy. <br />8. Driveway Access. Vehicular access shall not be allowed directly onto Capital <br />Avenue except as shown on the approved development plan. <br />9. Design and Construction. No building shall be constructed within the <br />Subdivision except within the Building Envelope Areas as defined on the Development Plan (Exhibit <br />"A "). The buildings to be constructed shall be consistent with the designs approved with the <br />Development Plan to include one (1) three -story apartment building with sixty (60) apartment units <br />and eight (8) ten -unit apartment buildings and two (2) detached garages on located north of the 60 <br />unit building and one located to the south of the same building. The exterior of the buildings shall be <br />architecturally and aesthetically compatible in material and color. No portion of any building <br />constructed (including architectural features) shall exceed a height of 50 feet above the center of the <br />intersection of Capital Avenue and the western most drive way on lot 1. <br />10. Landscaping. The Subdivider agrees to comply with the requirements of the <br />Landscaping Regulations of the City of Grand Island, and plans as submitted to and approved by the <br />City's Building Department. The Subdivider shall install and maintain the existing landscaping at its <br />own expense. No buildings or other structures shall be permitted outside of the building envelopes <br />in a manner that encroaches into the required landscape buffer. <br />11. Engineering Data. All final engineering plans and specifications for public <br />improvements shall bear the signature and seal of a registered professional engineer and shall be <br />furnished by the Subdivider to the Department of Public Works for approval prior to contracting for <br />construction of any improvements.
