4 201502484 the subdivision, the Subdivider agrees to install public sidewalks within one year of the completion of such street improvement district in accordance with the City of Grand Island Sidewalk Policy. 8. Driveway Access. Vehicular access shall not be allowed directly onto Capital Avenue except as shown on the approved development plan. 9. Design and Construction. No building shall be constructed within the Subdivision except within the Building Envelope Areas as defined on the Development Plan (Exhibit "A "). The buildings to be constructed shall be consistent with the designs approved with the Development Plan to include one (1) three -story apartment building with sixty (60) apartment units and eight (8) ten -unit apartment buildings and two (2) detached garages on located north of the 60 unit building and one located to the south of the same building. The exterior of the buildings shall be architecturally and aesthetically compatible in material and color. No portion of any building constructed (including architectural features) shall exceed a height of 50 feet above the center of the intersection of Capital Avenue and the western most drive way on lot 1. 10. Landscaping. The Subdivider agrees to comply with the requirements of the Landscaping Regulations of the City of Grand Island, and plans as submitted to and approved by the City's Building Department. The Subdivider shall install and maintain the existing landscaping at its own expense. No buildings or other structures shall be permitted outside of the building envelopes in a manner that encroaches into the required landscape buffer. 11. Engineering Data. All final engineering plans and specifications for public improvements shall bear the signature and seal of a registered professional engineer and shall be furnished by the Subdivider to the Department of Public Works for approval prior to contracting for construction of any improvements.
