<br /> 19. Legislation. If, after the date hereof, enactment or expiration of applicable laws have the effect either of rendering :
<br /> the provisions of the Note, the Deed of Trust or any Rider, unenforceable according to their terms, or all or any part
<br /> of the sums secured hereby uncollectible, as otherwise provided in this Deed of Trust or the Note, or of diminishing :
<br /> the value of Lender's security, then Lender, at Lender's option, may declare all sums secured by the Deed of Trust to
<br /> be immediately due and payable. :
<br /> 20. Release. Upon payment of all sums secured by this Deed of Trust, this Deed of Trust shall become null and void
<br /> and Lender or Trustee shall release this Deed of Trust without charge to Borrower. If Trustee is requested to release :
<br /> this Deed of Trust, all instruments evidencing satisfaction of the indebtedness secured by this Deed of Trust shall be
<br /> surrendered to Trustee. Borrower shall pay all costs of recordation, if any. Lender, at Lender's option, may allow a
<br /> partial release of the Property on terms acceptable to Lender and Lender may chazge a release fee.
<br /> 21. Waiver of Homestead. Borrower hereby waives all rights of homestead exemption in the Property.
<br /> 22. Hazardous Substances. Borrower shall not cause or permit the presence, use, disposal, storage, or release of any
<br /> Hazardous Substances on or in the Property. Borrower shall not do, nor allow anyone else to do, anything affecting :
<br /> the Property that is in violation of any Environmental Law. The preceding two sentences shall not apply to the presence, :
<br /> use, or storage on the Property of small quantities of Hazardous Substances that are generally recognized to be :
<br /> appropriate to normal residential uses and to maintenance of the Property. :
<br /> Borrower shall promptly give Lender written notice of any investigation,claim, demand, lawsuit, or other action by any :
<br /> govemmental or regulatory agency or private party involving the Property and any Hazardous Substance or :
<br /> Environmental Law of which Bonower has actual knowledge. If Borrower learns, or is notified by any governmental :
<br /> or regulatory authority, that any removal, or other remediation of any Hazardous Substance affecting the Property is :
<br /> necessary, Borrower shall promptly take all necessary remedial actions in accordance with Environmental Law. :
<br /> As used in this paragraph 22, "Hazardous Substances" are those substances defined as toxic or hazardous substances :
<br /> by Environmental Law and the following substances: gasoline,kerosene, other flammable or toxic petroleum products, :
<br /> toxic pesticides and herbicides, volatile solvents, materials containing asbestos or formaldehyde, and radioactive :
<br /> materials. As used in this paragraph 22, "Environmental law" means federal laws and laws of the jurisdiction where :
<br /> the Property is located that relate to health, safety, or environmental protection. :
<br /> 23. Substitute Trustee. Lender may from time to time in Lender's discretion remove Trustee and appoint a successor :
<br /> trustee to any Trustee appointed hereunder. Without conveyance of the Property, the successor trustee shall succeed :
<br /> to all the title, power and duties conferred upon the Trustee herein and by applicable law. :
<br /> REQUE5T FOR NOTICE OF DEFAULT AND FORECLOSURE
<br /> On behalf of each party hereto, Bonower requests that a notice of default and a copy of any notice of sale hereunder :
<br /> be mailed to each person hereto at the address of such person set forth herein, all at the same time and in the same :
<br /> manner as would be required if a separate request therefor had been filed by each of such persons. :
