<br />The undersigned makes no representation or warranty that the rate of interest or finance charge earned by the
<br />undersigned on said note may be legally collected by Assignee, and Assignee makes at its own risk its determination
<br />regarding whether it can collect said rate of interest or finance charge. Assignee shall have no recourse against the
<br />undersigned in the event of the uncollectibility for any reason of either the principal or interest or finance charge on
<br />the note and deed of trust hereby assigned or for any other reason, and Assignee shall have no right to indemnity or
<br />contribution from the undersigned for any claim, demand, cost or damage requested by the borrower on the within
<br />note and deed of trust or for any attorneys' fees incurred by Assignee in defending against any such claim or in
<br />collecting the note and deed of trust hereby assigned.
<br />NOTICE: This deed of trust may be subject to special rules under the Federal Truth -in- Lending Act. Purchasers or
<br />assignees of this deed of trust could be liable for all claims and defenses with respect to the deed of trust that the
<br />borrower could assert against the creditor.
