<br /> THIS DEED OF TRUST is made this � day of February,
<br /> 2000, by and among JAY RAINFORTH and KELLY RAINFORTH, husband and
<br /> wife, herein referred to as "Trustor" , whose mailing address is
<br /> 11743 S. 140 Road, Wood River, Nebraska 68883; BRUCE I. SMITH,
<br /> Attorney-at-Law, hereinafter referred to as "Trustee" , whose
<br /> mailing address is P. O. Box 790, Grand Island, Nebraska 68802;
<br /> and HOWARD R. RAINFORTH, TRUSTEE OF THE HOWARD R. RAINFORTH AND
<br /> IVA P. RAINFORTH IRREVOCABLE REAL ESTATE TRUST DATED JANUARY 29,
<br /> 1991, hereinafter referred to as "Beneficiary" , whose mailing
<br /> address is 11743 S. 140 Road, Wood River, Nebraska 68883.
<br /> For valuable consideration, Trustor irrevocably grants,
<br /> transfers, conveys and assigns to Trustee, in trust, with power
<br /> of sale, for the benefit and security of Beneficiary, under and
<br /> subject to the terms and conditions of this Deed of Trust, the
<br /> Trustor' s interest in the following-described property located in
<br /> Hall County, Nebraska, to-wit:
<br /> A tract of land comprising a part of the Southwest
<br /> Quarter (SW�) of Section Seven(7 ) , Township Nine (9)
<br /> North, Range Eleven ( 11) West of the 6th P.M. , Hall
<br /> County, Nebraska, and more particularly described as
<br /> follows: Beginning at the northwest corner of said
<br /> Southwest Quarter (SW�) ; thence running southerly,
<br /> along and upon the west line of said Southwest Quarter
<br /> (SW�) , a distance of One Thousand Three Hundred and
<br /> Ninety-Four ( 1,394 .0) feet; thence deflecting left
<br /> 123�36 '25" and running northeasterly, a distance of
<br /> Nine Hundred Seventeen and Eighty-Four Hundredths
<br /> (917 .84) feet; thence deflecting right 33�27 ' 15" and
<br /> running easterly, a distance of Nine Hundred Eighteen
<br /> and Fifty-Seven Hundredths (918.57) feet; thence de-
<br /> flecting left 92�47 ' 00" and running northerly, a dis-
<br /> tance of Eight Hundred Ninety-One and Nine Hundredths
<br /> (891.09) feet to a point on the north line of said
<br /> Southwest Quarter (SW�) ; thence deflecting left
<br /> 87�17 ' 15" and running westerly, along and upon the
<br /> north line of said Southwest Quarter (SW�) , a distance
<br /> of One Thousand Six Hundred Thirty-Seven and Thirty-Six
<br /> Hundredths ( 1,637 .36) feet to the point of beginning,
<br /> together with all improvements, fixtures and appurtenances lo-
<br /> cated thereon or in any way pertaining thereto, and the rents,
<br /> issues, profits, reversions and the remainders thereof, including
<br /> all such personal property that is attached to the improvements
<br /> so as to constitute a fixture, all of which, including replace-
<br /> ments and additions thereto, are hereby declared to be a part of
<br /> the real estate conveyed in trust hereby, it being agreed that
<br /> all of the foregoing shall be hereinafter referred to as the
<br /> "Property" .
