Payne for and in consideration of the amount set forth in this easement, does hereby grant unto Southern Public Power District; a public corporation whose post office address is Grand Island, Nebraska, and to its successors or assigns; the right to enter upon the lands of the undersigned, situated in the County of Hall , State of Nebraska and more particularly described as follows: The Southerly thirty -five (35) feet of a tract of land located in the Southwest Quarter of the Southeast Quarter (SW1 /4- SE1 /4) of Section Sixteen (16), Township Twelve (12) North, Range Ten (10) West of the 6 P.M., Hall County, Nebraska. Above party hereby grants permission as follows: For Southern Public Power District to build overhead power lines on the above - described tract of land. And to place, construct, operate, repair, maintain, relocate and replace thereon an electric transmission line, and to cut and trim trees and shrubbery to the extent necessary to keep them clear of said electric line, and to cut down from time to time all dead, weak, leaning or dangerous trees that are tall enough to strike the wires in falling. In granting this easement it is understood that at pole locations, only a single pole will be used, and that the location of the poles will be such as to form the least possible interference to farm operations, so long as it does not materially increase the cost of construction. Poles and/or anchors are not to be installed more that two feet inside property line, except as following: Power poles and anchors are to be installed on the above - described tract of land. Compensation for this easement shall be in the amount of $25.00 per pole and/or anchor placed on the lands of the undersigned. Payment will be made after construction plans are final and number of poles and/or anchors can be determined. Grantor will be reimbursed for all crop damage caused during construction of the line. The undersigned covenants that he is the owner of the above described lands and that the said lands are free and clear of encumbrances and liens of whatsoever character except those held by the following persons: It is further understood that, whenever necessary, words used in this instrument in the singular shall be construed to read in the plural and that words used in the masculine gender shall be construed to read in the feminine.
