Signed and delivered <br />In the presence of: <br />STATE OF kebret.sk <br />2 <br />DO NOT WRITE ABOVE THIS LINE – FOR REGISTER OF DEEDS USE ONLY <br />34.5KV & 69KV TRANSMISSION LINE RIGHT -OF -WAY EASEMENT <br />SOUTHERN PUBLIC POWER DISTRICT f' j <br />PO BOX 1687, GRAND ISLAND NE 68802 -1687 '� <br />I <br />ra <br />` , ry <br />O <br />b "> <br />. : r'rt <br />ri 2Y r -7 O <br />-,, r .....113 <br />o f--+ (1) <br />w <br />r <br />C11 cn W <br />c <br />, <br />KNOW ALL MEN BY THESE PRESENTS, that the undersigned B & N Farms Trust for and in consideration <br />of the amount set forth in this easement, does hereby grant unto Southern Public Power District; a public corporation <br />whose post office address is Grand Island, Nebraska, and to its successors or assigns; the right to enter upon the <br />lands of the undersigned, situated in the County of Hall , State of Nebraska and more particularly described as <br />follows: <br />The Southerly thirty -five (35) feet of a tract of land located in the East Half of the Southwest Quarter (E1 /2 -SW 1/4) <br />and the Southeast Quarter (SE1 /4), all in Section Sixteen (16), Township Twelve (12) North, Range Ten (10) West <br />of the 6 P.M., in Hall County, Nebraska, except a tract of land consisting of the southerly 940 feet of the westerly <br />670 feet of the Southwest Quarter of the Southeast Quarter (SW1 /4- SE1 /4) of Section Sixteen (16), Township <br />Twelve (12) North, Range Ten (10), West of the 6 P.M., Hall County, Nebraska, said tract containing 14,457 acres, <br />more or less, the southerly 33 feet being county road right -of -way. <br />Above party hereby grants permission as follows: For Southern Public Power District to build overhead power lines <br />on the above - described tract of land. <br />And to place, construct, operate, repair, maintain, relocate and replace thereon an electric transmission <br />line, and to cut and trim trees and shrubbery to the extent necessary to keep them clear of said electric line, and to <br />cut down from time to time all dead, weak, leaning or dangerous trees that are tall enough to strike the wires in <br />falling. <br />In granting this easement it is understood that at pole locations, only a single pole will be used, and that the <br />location of the poles will be such as to form the least possible interference to farm operations, so long as it does not <br />materially increase the cost of construction. Poles and/or anchors are not to be installed more that two feet inside <br />property line, except as following: Power poles and anchors are to be installed on the above - described tract of land. <br />Compensation for this easement shall be in the amount of $25.00 per pole and/or anchor placed on the <br />lands of the undersigned. Payment will be made after construction plans are final and number of poles and/or <br />anchors can be determined.
