HOLLISTER, Trustee of the Richard D. Hollister Revocable Trust; MARJORIE C. HOLLISTER, Trustee of the Marjorie C. Hollister Revocable Trust; SCOTT D. HOLLISTER, Trustee of the Scott D. Hollister Revocable Trust; RITA L. HOLLISTER, Trustee of the Rita L. Hollister Revocable Trust; CRAIG A. HOLLISTER, Trustee of the Craig A. Hollister Revocable Trust; and NANCY L. HOLLISTER, Trustee of the Nancy L. Hollister Revocable Trust for and in consideration of the amount set forth in this easement, does hereby grant unto Southern Public Power District; a public corporation whose post office address is Grand Island, Nebraska, and to its successors or assigns; the right to enter upon the lands of the undersigned, situated in the County of Hall, State of Nebraska described as follows: A tract of land comprising a part of the Southeast Quarter (SE1 /4) of Section Thirty-Two (32), Township Nine (9) North, Range Nine (9) West of the 6 P.M., Hall County, Nebraska, more particularly described as follows: Beginning at the Southeast corner of said Southeast Quarter; thence Northerly along the East line of said Southeast Quarter a distance of 230.0 feet; thence Southwesterly 325.8 feet to a point on the Southerly line of the Southeast Quarter; thence Easterly along the South line of said Southeast Quarter a distance of 230.0 feet to the point of beginning. Above party hereby grants permission as follows: For Southern Public Power District to build overhead power lines on the above - described tract of land. And to place, construct, operate, repair, maintain, relocate and replace thereon an electric transmission line, and to cut and trim trees and shrubbery to the extent necessary to keep them clear of said electric line, and to cut down from time to time all dead, weak, leaning or dangerous trees that are tall enough to strike the wires in falling. In granting this easement it is understood that at pole locations, only a single pole will be used, and that the location of the poles will be such as to form the least possible interference to farm operations, so long as it does not materially increase the cost of construction. Poles and/or anchors are not to be installed more that two feet inside property line, except as following: Power poles and anchors are to be installed on the above - described tract of land. Compensation for this easement shall be in the amount of $1000.00. Payment will be made after construction plans are final. Grantor will be reimbursed for all crop damage caused during construction of the line. The undersigned covenants that he is the owner of the above described lands and that the said lands are free and clear of encumbrances and liens of whatsoever character except those held by the following persons: It is further understood that, whenever necessary, words used in this instrument in the singular shall be construed to read in the plural and that words used in the masculine gender shall be construed to read in the feminine.
