Huismann, being first duly sworn, deposes and states those facts of which he <br />has personal knowledge as set forth herein below: <br />1. That Affiant is President of Lacy Construction Company, a Nebraska corporation, <br />one of the Partners of Plaza Square, a Nebraska general partnership, Grantor in the Quitclaim <br />Deed dated January 26, 2015 and recorded on January 27, 2015 in the Office of the Hall County <br />Register of Deeds as Document Number 201500547 (the "Quitclaim Deed "), which said <br />Quitclaim Deed conveyed to Plaza Square Development L.L.C., a Nebraska limited liability <br />company, Grantee, the following described real estate, to -wit: <br />Lot Five (5) and the Westerly Twenty -Two (22) feet of Lot Six (6), Block Sixty - <br />Eight (68), Original Town of Grand Island, Hall County, Nebraska <br />2. That the Diocese of Grand Island conveyed the Subject Property to Plaza Square <br />partnership as sole grantee in a Corporation Warranty Deed recorded on November 9, 1981 in <br />the Office of the Hall County Register of Deeds under Document Number 81- 005627; <br />3. That upon the filing of a Certificate of Withdrawal of Partners and Addition of <br />New Partner on March 6, 1987 with the County Clerk's Office of Hall County, Nebraska under <br />Document Number 87A78, Lacy Building and Supply Co., Inc., n/k/a Lacy Construction <br />Company, and Don Huismann, a/k/a Donald F. Huismann, were the sole partners of Plaza Square <br />partnership; <br />4. That upon the filing of the Articles of Organization with the Office of the <br />Nebraska Secretary of State on September 26, 2001, Affiant organized Plaza Square <br />Development L.L.C. as successor to Plaza Square partnership; <br />5. That Donald F. Huismann died on July 22, 2014 and the Hall County Court of <br />Hall County, Nebraska appointed Gerald A. Huismann and Julie M. Griess as Personal <br />Corepresentatives of the Estate of Donald F. Huismann on August 6, 2014; <br />6. Upon the death of Donald F. Huismann, said Donald F.
