The Initial Loans are evidenced by <br /> certain Secured Promissory Notes dated as of June 21, 2005 in the original principal sums of <br /> $1,435,500.00 and $434,149.00 respectively (collectively, the "Initial Notes"). <br /> To further evidence, secure and guarantee the outstanding indebtedness of the Initial Notes, the <br /> Grantor executed and delivered to Secured Party/Beneficiary (i) a certain Deed of Trust, Assignment of <br /> Rents and Security Agreement dated June 13, 2005 and filed of record in Hall County, Nebraska on June <br /> 21, 2005 as Instrument No. 200505595, (the "Deed of Trust") against the real property more particularly <br /> described in Exhibit A attached hereto and made a part hereof, (ii) those certain Loan and Security <br /> Agreements made by Grantor in favor of Secured PartylBeneficiary dated as of June 21, 2005, <br /> (collectively, the "Security AgreemenY'), (iii) certain Environmental and Indemnification Agreements dated <br /> as of June 21, 2005 made by the Grantor and certain guarantor(s) (collectively, the "Environmental <br /> Indemnity"), and (iv) certain other loan documents including certain guaranty(ees) each dated as of June <br /> 21, 2005 (individually and collectively, the "Guaranty").
