ANDERSON, a single person, (Grantor), in consideration r �� <br /> of TWENTY-FIVE THOUSAND DOLLARS ($25,000.00) paid, receipt of which is hereby <br /> acknowledge, does hereby grant, bargain, sell and convey to the CITY OF GRAND ISLAND, <br /> NEBRASKA, a Municipal Corporation(Grantee),a permanent and perpetual easement for drainage, <br /> flood control, storage, monitoring and testing of surface waters in and through the lake, known as <br /> Firethorne Lake,located on the tracts of land described in E�ibit A attached hereto and made a part �' ' <br /> hereof by reference. <br /> The drainage easement granted herein to the City of Grand Island shall be subject to the <br /> following mutual terms and conditions: <br /> a. The Grantors reserves the right to use the tract of real estate described in E�ibit A <br /> including the waters located thereon, in any manner not inconsistent with or in derogation of the <br /> drainage easement conveyed herein to the Grantee and may enlarge,reduce or reconfigure the lake <br /> located on the Grantors' real estate as the Grantors deems necessary and prudent. <br /> b. The Grantee may introduce waters into the lake through either the natural drainage <br /> existing at the time of this conveyance or by means of a weir and underground conduit from the lake <br /> located in the South Half of the Southwest Quarter(S �/2 SW 1/4)of Section 27,Township 11 North, <br /> Range 9 West of the 6th p.m. in Hall County,Nebraska, commonly known as Vanosdall Lake. The <br /> source of the waters subject to this drainage easement shall be limited to the lands shown on diagram <br /> E�ibit B attached hereto and made a part hereof. <br /> - 1 - <br />
