<br /> Z1. Hazardou�Substances.As used in this Section�1: (a} "Hazardous,Suh.sta►�ce.s"are those substances
<br /> defined as toxic or hazardous substances,pollutants,or�vastes by Environmental Lavv and the fallowing
<br /> substance�: gas�line,kerosene,other flammable or taxic p�troleum praducts,toxi�pestiGide�and herbicides,
<br /> volatile solvents, materials cantaining asbestos or formaldehyde, and radioactive materials; (b} '
<br /> "��vironrr�e�tal La�"means federa��a�vs and�a�vs af the jur�sd�ction�here the Prop�rty�s�vcated tha�
<br /> relate t�health, safety or environmental protection; (c) "�r�vzror�me►�tal Clear�up"includes any response
<br /> action, remedial actian, or removal action, �s def�ned in Enviranmental Law; and(d}an "�'raviror�►nera�al
<br /> Condxt�or�"meaas a cond�tion that can cause,contribute ta, or otherwise trigger an En�ironmental�leanup.
<br /> Borravver sha11 not cause or permit the presence,use,disposal, storage,or release af any Hazardous
<br /> Su�stances, vr threaten to relea��any Hazardous Substa.nc�s,on ar in the Prop�r�.Borrower sha11 not do,
<br /> nor a11ow anyone else to d�,anything affecting the Property�a)that is in violation af any Environmental
<br /> Law, (b}�h�ch creates an�a�iranmen�al CQndition,or(c}which,due to the presence,use,or release af a
<br /> Hazardou�Substance,creates a cond�tion that adversely affects the value of the Property. The preceding two
<br /> sentences sha11 not apply to the presence,use,or storage on the Prope�ty of sma11 quantities of Hazardous
<br /> Substances that are genera�ly recognized to be apprapriate to normal res�dentia�uses and to maintenance af
<br /> the Proper�y(inc�ur�ing,bu�no�limited ta,�iazardous substances in consumer products�,
<br /> Borrower sha11 prQmptly give Lend�r written notice of(a}any investigation,claim,demand, �awsuit or other
<br /> action by any go�ernmenta,l or regulatory agency or private party involving the I'roperty and any Haaardaus
<br /> Substance or Environmentai Law of which B�rrower has actua�kno�v�edge,(b)any En�ironmental
<br /> Condition, including but not 1im�ted to,aay spilli.ng, �ea�ing,discharge,release or threat of release of any
<br /> Hazardous Substaace,aad�c}any condition ca�sed b�the presence,use or r�e�ease of a Hazara�Us Substa�.ce
<br /> which adversely affects the value of the Property. If Borrower learns,or is notified by any governmental or
<br /> regulatory authority,or any pri�ate party,that any remo�al or other remediation of any Ha2ardous Substanc�
<br /> affecting the Property is necessary,Borrower shalt promptly take a11 necessary remedial actions in
<br /> accardanc�w�th Enviranmental�aw,Nathing herein sha11 cr�ate any obligation�n Lender for an
<br /> Environmentat�leanup.
<br /> Non-U nifvrm�o��nants.Borrower and Lender cavenant and agree as follows:
<br /> ZZ. Acceleration;Remedies.Lender shall give n�tice to Borrawer prior t� ac�eler�tion f�llowing
<br /> B�rr�wer's breach�f any covenant ar agreement in this�ecurity Instrument��ut n�t priar ta
<br /> acceleration under Section 1S unless Applicable Law pravides atherwise�.The nvtice shall specify: �a}
<br /> the default;{b)tl�e a�#ian required to cure the default;{c}a date,nat��ss th�n 3U days from the date
<br /> the n�tice is gi�en ta Barrower,by which the default must be cured;and�d}tbat failure to cure the
<br /> default an or befnre the date specified in the notice may result in�cceleration�f the sums secured by
<br /> �h�s Security In�trument and sale of the Pr�pert�.The notice shall further inform Borr�w�r of the �
<br /> right ta reinstate after accelerativn and the right t�bring a court�ction ta assert the n�n-existence af a
<br /> default or any other defense of Borrower to acceleraii�n�nd saie.If the defau�t is n�t cured on or
<br /> before the date specif ed fn the not�ce,�.ender at it�vptior�ma�require i�nrr�ediat��aymen�t in fu��of
<br /> � all sums secured by this Security Instrument with�ut further demand and may in�Qke the power�f sale
