As used �n this Section 21: �a� "Ha�ard�us 5ubs�ances"are those suhstances <br /> defined as tox�c ar hazardous substances, poiiutants. or waste� by En►►ironrnental Law and the following <br /> substances:gasoline. kerflsene. other flammable or toxic pe#ro�eum praducts. toxic p�sticides and herbitides� <br /> �olatile so�vents, mat�rial5 �ontaining asbestos ar farmaldehyde. and radiaaetive ma�erials; ��} <br /> "Environmental Law"means federal laws and laws �f the jurisdicti�n where �h� Property �s loeated �hat <br /> relat� to health. safety or envir�nmenta! protecti�n; �c) "En�ironm�ntal Cleanup"includes any response <br /> a�tion, remed�al action, or remo�al acti�n, as defined in En�ironmental Law; and �d} an "Fn�ironmental <br /> Condi�ion"means a condition that can cause. contribute to, �r othQrwise trigger an En�ironmental Cleanup. <br /> B�rrawer sha�l not cau�e or permit the presence, us�, dispasal, s�vrag�� or release of any Ha�ardous <br /> 5ubstances, or thr�aten to reiease any Hazard�us Substan�es, on or in thp Property. Borr�wer shall not do� <br /> nor a�low anyone else ta d�. anything affecting the Pr�perty �a� that is in �iolation of any En�ironmental <br /> �aw, �b} whieh creates an Environrn�nta� �andi��on, or tc�which. due to the pre�ente, wse, �r release of a <br /> Hazard�u5 5ubstan�e, creates a��nditi�r� that�d�e�se�y af�ects the Walue of the Property. The pre�ed�ng twa <br /> sentences shall not apply to the presence, use, �r s�orage �n the P�aperty of sma�l quantities of Ha�ardous <br /> Substances that are generally retognize� to be appropr�ate ta n�rmal residential uses and to maintenance of <br /> the Property�in�luding, but not limited to, hdZd�'doUS SubStdnC�S fn�nns�mer�rvduCt5}, <br /> Sorrower shall pr�mQtly gi�� L�nder�rritten notice of�a�any in�estigati�n, ��aim, d�mand� lawsui� or other <br /> action by any gavernmental ar regulatory agency or private par�y in�oiving the Prvperty and any Ha�ardo�s <br /> Substanc� or EnWiranm�nta! Law of wh�eh Borrower has actual knowledge, �h} any Env�ronrn�ntal <br /> Condit�on, includ�ng but nvt limited to, any sp�lling, leaking, dis�harge, release o� threat of release of any <br /> Hazardous 5ubstanc�, an� ���any�ond�t�on taused by th� presente, use or release of a Hazardous 5uhstance <br /> which ad�ersely affects the�aiue �f the Property. I�Borrower learns. ar is r�otif�ed by any g�vernmental or <br /> regulatary authority, or any pri►►ate party,�hat any remo�al or oth�r remed�ation of any Hazardous�ubstan�e <br /> affec�ing the Property is netessary, Borrower shall pramptly �ake a�i n�cessary remediai actians in <br /> a�cordance with En�ir�nmentai La�. Nathing h�rein shall �r�ate any o�iigation on Lender fnr an <br /> En�ironmentaf Cleanup. <br /> N�n-�nifarm Cavenants. Barrawer and Lende�co�enant and agree as fallvws: <br /> ��. Acceleration; Remedies. l.ender �hall gi�e nati�� to Barrawer pri�r to a��eiera�ion following <br /> Barrower's breach of any �o�enant or agreement ir� this 5�curity Instrument �but not Rr�ar to <br /> ac�eleration un��r SectiQn 18 uniess Applicahle �.aw pro�id�s �therwise}.
