� � <br /> � - �00000293 <br /> hazardous or toxic substance, material or waste, including without <br /> limitarion asbestos, petroleum, or material containing or producing <br /> polychlorinated biphenyls (PCBs), is presently stored or located on the <br /> Property at levels greater than natural background concentrations. The <br /> Property is not subject to any "superfund" or similar lien or any claim by <br /> any government regulatory agency or third party related to the release or <br /> threatened release of any hazardous or toxic substance, material or waste. <br /> d. Ta.nks/Wells. There have not been and there are not now any underground <br /> or aboveground storage tanks, septic tanks or wells located on or under the <br /> Property or if there have been or are any such tanks or wells located on the <br /> Property, their location has been identified to the Conservancy in writing, <br /> they have been properly registered with all appropriate authorities, they are <br /> in full compliance with a11 applicable statutes, ordinances and regulations, <br /> and they have not resulted in the release of any hazardous or toauc <br /> substance, material or waste into the environment. <br /> e. Non-foreign Status. To inform the Conservancy that withholding of tax is <br /> not required under Section 1445 of the Internal Revenue Code and under <br /> penalties of perjury, Grantor hereby certifies that Grantor is not a non- <br /> resident alien or a foreign corporation, foreign parhiership, foreign trust or <br /> foreign estate as those terms are defined for purposes of federal income tax <br /> law and that Grantor's social security number/federal taxpayer <br /> identification number is as set out below. Grantor understands that this <br /> certification may be disclosed to the Internal Revenue Service and that any <br /> false statement made could be punished by fines, imprisonment or both. <br /> f. Broker's Claims. Grantor has not employed a real estate agent or broker in <br /> connection with the sale of the property. <br /> g. Government Farm Pro�. The property is not enrolled in the <br /> Agricultural Market Transition Act Program, the Conservation Reserve <br /> Program, the Wetland Reserve Program or any other program of the United <br /> States Depariment of Agriculture. The property is not subject to any <br /> government cost-share contracts or other agreements which restrict either <br /> the use of the property or the modification of any improvements. <br /> 19. REMEDIES. If Grantor is ready, willing and able to perform under the <br /> terms of this agreement but the Conservancy refuses to perform by paying the remaining <br /> monies due, Grantor shall be entitled to retain the monies already paid as consideration <br /> for this agreement as liquidated damages, the parties recognizing that this amount <br /> represents a fair estimate of damages far the breach of a contract of this nature and that <br /> - 14 - <br /> � <br />
