� � � - �00000293 hazardous or toxic substance, material or waste, including without limitarion asbestos, petroleum, or material containing or producing polychlorinated biphenyls (PCBs), is presently stored or located on the Property at levels greater than natural background concentrations. The Property is not subject to any "superfund" or similar lien or any claim by any government regulatory agency or third party related to the release or threatened release of any hazardous or toxic substance, material or waste. d. Ta.nks/Wells. There have not been and there are not now any underground or aboveground storage tanks, septic tanks or wells located on or under the Property or if there have been or are any such tanks or wells located on the Property, their location has been identified to the Conservancy in writing, they have been properly registered with all appropriate authorities, they are in full compliance with a11 applicable statutes, ordinances and regulations, and they have not resulted in the release of any hazardous or toauc substance, material or waste into the environment. e. Non-foreign Status. To inform the Conservancy that withholding of tax is not required under Section 1445 of the Internal Revenue Code and under penalties of perjury, Grantor hereby certifies that Grantor is not a non- resident alien or a foreign corporation, foreign parhiership, foreign trust or foreign estate as those terms are defined for purposes of federal income tax law and that Grantor's social security number/federal taxpayer identification number is as set out below. Grantor understands that this certification may be disclosed to the Internal Revenue Service and that any false statement made could be punished by fines, imprisonment or both. f. Broker's Claims. Grantor has not employed a real estate agent or broker in connection with the sale of the property. g. Government Farm Pro�. The property is not enrolled in the Agricultural Market Transition Act Program, the Conservation Reserve Program, the Wetland Reserve Program or any other program of the United States Depariment of Agriculture. The property is not subject to any government cost-share contracts or other agreements which restrict either the use of the property or the modification of any improvements. 19. REMEDIES. If Grantor is ready, willing and able to perform under the terms of this agreement but the Conservancy refuses to perform by paying the remaining monies due, Grantor shall be entitled to retain the monies already paid as consideration for this agreement as liquidated damages, the parties recognizing that this amount represents a fair estimate of damages far the breach of a contract of this nature and that - 14 - �
