- 200040224 <br /> PARTIAL RELEASE FROM DECLARATION OF TRUST <br /> Whereas, the Hall County Housing Authority, herein called the "Public Housing Authority <br /> (PHA)" a public body corporate and politic, created and organized pursuant to the laws of the <br /> State of Nebraska and the U.S. Department of Housing and Urban Development (HUD) <br /> pursuant to the United States Housing Act of 1937 (42 U.S.C. 1437, et seq.) and the <br /> Department of Housing and Urban Development Act (5 U.S.C. 624) entered into a certain <br /> contract with the effective date of April 30, 1962, herein called the Annual Contributions <br /> Contract, Contract Number C-352. <br /> Whereas, to assure HUD of the performance by the PHA of the covenants contained in <br /> the Annual Contributions Contract, the PHA possessing and holding in trust for the benefit of <br /> HUD executed a Declaration of Trust dated February 15, 1989, recorded on February 15, <br /> 1989, Instrument No. 89-100765, with the Register of Deeds of Hall County, Nebraska, with <br /> the Register of Deeds of Hall County, Nebraska, with respect to the following described real <br /> property including all buildings and fixtures erected or to be erected thereon or appurtenant <br /> thereto: <br /> Lot One (1), Block Three (3), Elm Place Addition to the City of Grand Island, Hall <br /> County, Nebraska, and its complement described as follows: A triangular piece of <br /> ground in the Southwest corner of Lot Twelve (12), in the County Subdivision of the <br /> Southeast Quarter of the Southwest Quarter (SE1/4SW1/4) of Section Sixteen (16), in <br /> Township Eleven (11) North, Range Nine (9) West of the 6th P.M., described as follows: <br /> Commencing at the iron pin in the SW corner of said Lot 12, thence running North <br /> along the West side of said lot, 16.7 feet; thence South on a line parallel with the West <br /> line of Block 3, in Elm Place Addition, 19.2 feet to the South side of said Lot 12, thence <br /> West, 9.5 feet along said South line to the point of beginning, being a right angle with a <br /> base of 19.2 feet. c/k/a 1303 West Division Street <br /> Whereas, the PHA intends to enter into and perform contracts for the sale of dwelling <br /> units to members of tenant families, as authorized by the United States Housing Act of 1937. <br /> Now by execution of this Release by the duly authorized officer of HUD subscribed <br /> below to allow the transfer of the property described above to Laurie Crumrine, HUD does <br /> hereby release said property from the trust created by the Declaration of Trust referenced <br /> above. <br /> In the event that the Hall County Housing Authority does not convey the property <br /> described above to the purchaser identified as Laurie Crumrine, this Partial Release from <br /> Declaration of Trust shall be void and without effect, in which case the Declaration of Trust � <br /> identified herein will remain in full force and effect. <br /> „ <br /> U.S. DE�A�Ef�TT O HO 1N AND URBAN DEVELOPMENT <br /> ; i <br /> I ' (" <br /> B � i Dated: �� <br /> harlie . ill� �1 '� <br /> Di , ' bf'Publi Housing <br /> 10909 Mill Valley Road <br /> Omaha, Nebraska 68154 <br />
