Hemingway a/k/a Kellie I. Hemingway and Shawn Jacobs, being first duly sworn upon oath, depose and state that: 1. Warren A. Monnington created the Warren A. Monnington Revocable Living Trust Agreement dated October 8, 1999, (the "Trust Agreement ") wherein he designated himself as the initial Trustee of the Trust Agreement, Wilma M. Monnington as the first successor Trustee and Kellie I. Hemingway and Shawn Jacobs as the subsequent successor Co- Trustees; 2. From the date of the creation of the Trust until February 19, 2014, Warren A. Monnington served as Trustee of the Trust; 4. Under date of March 27, 2014, Wilma M. Monnington executed an Acceptance of Trusteeship wherein she accepted the Trusteeship of said Trust Agreement and agreed to administer said Trust in accordance with the terms of said Trust Agreement and the laws of the State of Nebraska; 5. Pursuant to ARTICLE VIII, Paragraph B. of the Trust Agreement, the Warren A. Monnington Family Trust ( "Family Trust ") was created as a result of the death of Warren A. Monnington; 6. On December l 2014 Wilma M. Monnington executed a Resignation of Trusteeship resigning as Trustee under the Trust Agreement including the Family Trust due to advanced age, declining health and her desire not to continue with the responsibility for managing the trust property and by the execution of an Acceptance of Co- Trusteeship, Kellie M. Hemingway a/k/a Kellie I. Hemingway and Shawn Jacobs accepted the co- trusteeship under said Trust Agreement, including the Family Trust effective as of December / 7, 2014 and agreed to administer said Trust Agreement, including the Family Trust in accordance with the terms of said Trust Agreement and the laws of the State of Nebraska. 7. The Trust Agreement, including the Family Trust is irrevocable due to the death of the decedent, Warren A. Monnington and is in full force and effect; 8. The terms of the Trust Agreement grants Affiants as Co- Trustee all powers under the Nebraska Uniform Trust Code;
