Kohlhof, a single person, Trustors to Henderson State Bank dated <br />June 10, 2011 and recorded in the office of the Register of Deeds, Hall County, Nebraska on <br />June 14, 2011 as Instrument No. 201104428 encumbering the real property described therin <br />(collectively, the "Property "). Bank is the beneficiary under a Deed of Trust (the "Senior Deed <br />of Trust ") dated October 9, 2014 and recorded in the same office on October 28, 2014 as <br />Instrument No. 201406803 encumbering the property described herein. To induce Bank to <br />make a loan to the. Borrower secured by the Senior Deed of Trust, Lender has agreed to execute <br />and deliver this Subordination. Agreement. <br />ACCORDINGLY, in consideration of the premises and for other good and valuable <br />consideration, the receipt and sufficiency of which are hereby acknowledged, Lender hereby <br />agrees with Bank that the lien of the Junior Deed of Trust on the Property is and shall be and <br />remain fully subordinate for all purposes to the lien of the Senior Deed of Trust on the Property, <br />to the full extent of all sums from time to time secured by the Senior Deed of Trust; provided, <br />however, that the total indebtedness secured by the Senior Deed of Trust does not exceed <br />$127,500.00 exclusive to interest thereon, amounts advanced to protect the lien and priority of <br />the Senior Deed of Trust, and costs of collection. <br />LEGAL DESCRIPTION: <br />Part of the Northeast Quarter (NE %) of Section 4, Township 12 North, Range 11 West of the 6th P.M., <br />Hall County, Nebraska, more particularly described as follows; Commencing at the Northeast corner of <br />the Northeast Quarter (NE'/) of Section 4; thence running westerly along and upon the North line of <br />Section 4 a distance of 965 feet to the actual point of beginning; thence running southerly parallel to the <br />easterly boundary line of said Section 4 a distance of 594 feet; thence running Westerly parallel to the <br />Northerly boundary line of said Section 4 a distance of 396 feet; thence running northerly parallel to the <br />easterly boundary line of said Section 4 a distance of 594 feet to the North line of Section 4, Township 12 <br />North, Range 11 West of the 6th P.M., thence running Easterly along and upon the Northerly line of said <br />Section 4 a distance of 396 feet to the point, of beginning. <br />IN WITNESS THEREOF, this Subordination Agreement is executed on the day and year first <br />above stated. <br />State of Nebraska ) <br />) ss: <br />County of Greeley ) <br />HENDERSON STATE BANK <br />hn A.
