Lowry, being first duly sworn upon his or her oath, deposes and says: <br />1. That the Affiant is the successor trustee under the terms and conditions of the Robert <br />W. Lowry Revocable Trust dated May 30, 2013, which is now known as the Robert W. Lowry <br />Administration Trust (hereinafter referred to as the "said Trust "). <br />2. That on November 24, 2014, the Affiant became the successor trustee of the said <br />Trust following the death of Robert W. Lowry on April 26, 2014, the settlor and initial trustee of said <br />Trust, a certified copy of his death certificate is attached as Exhibit "A ", and upon signing an <br />Acceptance to Act as Trustee under the Robert W. Lowry Trust Agreement, an original of which is <br />attached as Exhibit "B ". <br />4. That among the assets of the said Trust is the following described real property that <br />was conveyed to the trustee of the said Trust on May 30, 2013, by Warranty Deed recorded on June <br />3, 2013, in the records ofthe Buffalo County Register ofDeeds Office as Instrument No. 201304325: <br />An undivided one -half ( interest in and to the Southeast Quarter (SE%) of <br />Section Two (2), Township Eleven (11), North Range Twelve (12) West of the <br />6th P.M., Hall County, Nebraska; <br />An undivided one -half (%Z) interest in and to the Southwest Quarter (SW%) of <br />Section Two (2) and the Northeast Quarter of the Southeast Quarter (NE %SE /4) <br />of Section Three (3), Township Eleven (11) North, Range Twelve (12) West of <br />the 6 P.M., Hall County, Nebraska; <br />An undivided one -half ( interest in and to the Southwest Quarter (SWl) of <br />Section Twenty -four (24), Township Twelve (12) North, Range Twelve (12) <br />West of the 6 P.M., Hall County, Nebraska, EXCEPT a tract of land <br />comprising the westerly Four Hundred Eighty-five (485.0) feet of the southerly <br />Six Hundred Eighty-seven (687.0) feet of the Southwest Quarter of the <br />Southwest Quarter (SW /4SW /4) of said Section 24 (said exception contains 7.649 <br />acres, more or less); and <br />An undivided one -half (%) interest in and to a tract of land in the Southwest <br />Quarter (SW%) of Section Twenty-four (24), Township Twelve (12) North, <br />Range Twelve (12) West of the 6 P.M., Hall County, Nebraska, described as <br />follows: Starting at a point on the Section Line on the South side of said Section <br />2035.6 feet East of the Southwest corner of said Section 24, thence East a <br />distance of 200 feet on said south section Line, thence North to Left at an angle <br />of 89 °30' a distance of 257 feet, thence to the West to the Left at an angle of <br />90 °30' a distance of 200 feet, thence South to the left at an angle of 89 °30' a <br />distance of 257 feet to the point of beginning (said tract contains 1.18 acres, more <br />or less). <br />
